북한주민 재산관리의 실효성 확보 방안

In this study, a way to secure the effectiveness of the property management of North Koreans was sought. The main contents are summarized as follows. First, as a family court that knows better than anyone that North Koreans have acquired inherited property, it is desirable to allow them to appoint a property manager “ex officio” for North Koreans. Second, in order to enhance the effectiveness of property management, it is necessary to appoint an expert property manager rather than a relative property manager. Third, it is desirable that an administrative agency (trust agency), not a private person like in Taiwan, be in charge of managing the property of North Koreans. Fourth, there should be a legal basis for dispositions or orders to property managers so that the Minister of Justice can effectively and thoroughly supervise the property management of North Koreans. Fifth, the trust system should be actively used as a policy tool for long-term protection and management of the property of North Koreans, since it is possible to secure the professionalism of the trustee, the financial institution, and the independence of the trustee's property. Sixth, it is necessary to revise laws that reflect the peculiarities of property management of North Koreans regarding the reasons for the resignation of property managers and termination of property management for North Koreans.
