해사안전법 제96조와 1972년 국제해상충돌예방규칙 제2조의 관계

A Study on the Relationship between Article 96 of the Marine Safety Act and Rule 2 of the International Regulations for Preventing Collisions at Sea 1972

초록

해사안전법 제96조의 문구는 국제규칙 제2조와 다소 상이한 점이 있으나 대체적으로 국제규칙 제2조와 그 입법취지는 동일하다. 따라서 선원의 상무란 해기실무에 능통한 해원이 갖추어야 할 통상적인 기술과 보통의 지능을 의미하는 것으로 해석할 수 있다. 다만 선원의 상무란 항해술의 발달 등에 따라 계속적으로 진화하는 것으로서, 그 개념을 일의적으로 파악하기 어려운 불확정 개념이라는 점을 감안하면 선원의 상무를 개별 선원에 대한 행위규범 내지 재판규범으로서 적용하기에는 분명한 한계가 있다. 한편 본질적으로 국제규칙 제2조와 해사안전법 제96조는 선박운항상 요구되는 주의의무를 위반함으로 인해 선박충돌을 야기한 선박소유자, 선원 등이 책임을 부담한다는 점을 명확히 한 규정이다. 해사안전법 제96조 제1항이 해원 등에 대한 선박충돌 등의 특수한 상황에서의 합당한 주의의무에 대해 규정하고 있지만, 이러한 주의의무는 그 성질상 위 법규정에 명문화 되어 있지 않더라도 정상적 예견능력을 갖춘 신중한 조선자라면 당연히 갖추어야 할 것이라는 점에서, 해사안전법 제96조에 의해 새롭게 규정되거나 추가적으로 규정된 주의의무라고 볼 것은 아니다. 이러한 점에서 해사안전법 제96조 제1항 및 제3항의 입법취지는 국제규칙 제2조 제1항의 그것과 동일하다. 국제규칙 제2조 제2항 및 해사안전법 제96조 제2항의 요체는 해원 등으로 하여금 항해상 위험 및 충돌의 위험, 그리고 모든 특수한 상황에 관한 상당한 주의를 기울일 것을 요구하면서, 그러한 합당한 주의의무의 이행을 다한 경우에는 책임을 부담하지 않는다는 점을 명확히 하였다는 점에서 소위 '보편적 신중성의 법리(the general prudential rule)'를 확인한 것에 그 의의가 있다. 국제규칙 제2조 제2항의 핵심은 해원 등이 처한 상황이 일반적인가 또는 특수한 것인가에 있는 것이 아니라, 위험의 절박성(the immediacy of the danger)과 실정법규상 항법규정으로부터 벗어나서 운항해야 할 필요성(the necessity of departure)의 문제이다.

Abstract

Even if the wording of Article 96 of the Marine Safety Act is somewhat different from Rule 2 of the International Regulations for Preventing Collisions at Sea 1972 (hereunder 'COLREG'), but in general, the legislative purposes of both them are almost the same. Therefore, the Good Seamanship means taking every precaution that may be required by the ordinary practice of seamen. However, given that the good seamanship is an indeterminate concept that is difficult to understand uniquely, as it continuously evolves according to the development of navigational skills, etc., there should be a clear limit to applying the good seamanship as a code of conduct or trial for individual seafarers. On the other hand, in essence, Rule 2 of the COLREG and Article 96 of the Marine Safety Act are provisions that clarify that the shipowner, crew, etc., who cause a ship collision by violating the duty of due diligence required for ship operation, bear the responsibility Article 96 Paragraph 1 of the Marine Safety Act stipulates the duty of due care to seamen in special circumstances. However, considering that this duty of care should be provided by a prudent seafarer with normal foresight ability and skill, even if it is not stipulated in the law, the above duty cannot be regarded as newly or additionally prescribed by Article 96 of the Marine Safety Act. To this regard, the legislative purpose of Article 96 (1) and (3) of the Marine Safety Act is the same as that of Rule 2 (a) of the COLREG. The gist of Rule 2(b) of the COLREG and Article 96 paragraph (2) of the Marine Safety Act requires master, etc. to pay due regard to all dangers of navigation and collision and to any special circumstances. Furthermore, the clause confirms the so-called 'general prudential rule' in that it is clear that crews, etc. do not bear responsibility for fulfilling such due regard. The heart of Rule 2(b) of the COLREG is not a matter of whether the nature of circumstances which crews face are general or special, but rather the question of the immediacy of the danger and the necessity for departure from the Rules of navigation regulations.
