개인정보의 경제적 거래 가능성에 관한 연구

개인정보는 그 자체로는 경합성(rivalry), 배제 가능성(excludability), 압류 가능성(seizability) 등을 갖추고 있지 않아 경제적 거래의 대상이 되기 어렵다. 그러나 개인정보의 귀속과 활용에 대한 법률적인 권리 부여(entitlement)와 보호를 통해 개인정보는 경제적 거래의 대상이 될 수도 있다. 그러나 현행 동의기반 체제(consent-based system)에 근거한 개인정보의 유통은 개인정보의 불완전한 보호, 정보제공에 대한 불명확한 보상, 익명화에 따르는 개인정보의 품질 저하 등 많은 문제를 내포하고 있다. 본 연구에서는 개인정보에 대한 일체의 권리는 개인에게 귀속되고 이 권리를 금지 명령(injunction)을 통해 보호하는 방식으로 개인정보에 대한 재산권(property right)을 명확히 획정하는 방안을 검토하였다. 이 경우 개인정보주체는 자신의 선택에 따라 자신의 개인정보를 강력하게 보호할 수도 있고, 또는 경제적 대가를 수령하고 시장에 거래 대상으로 제공할 수도 있다. 아울러 각 개인정보주체가 직접 시장에 참가하는 직접 참가 방식보다는, 시장거래에 제공될 개인정보를 경제적 대가를 지불하고 수집ㆍ축적하는 개인정보수집처리자를 통해 간접적으로 참여하는 데이터 거래소 제도가 거래비용을 절감하고 개인정보의 유통과 활용을 제고할 수 있다는 점도 살펴 보았다. 본 연구는 이러한 관점에서 유럽의 최신 개인정보법제인 GDPR(General Data Protection Regulation)의 의미를 조명하고, 아울러 GDPR의 취지를 일부 계승한 것으로 알려진 개정 신용정보법의 미비점을 지적하고 마이데이터 사업 방향의 개선을 제안하였다.
Abstract
Personal data do not exhibit rivalry and excludability which are standard characteristics needed for economic transactions. This imperfection, however, can be cured in principle through the appropriate entitlement and protection of personal data. The consent-based system that is widely used for the circulation of personal data does not live up to this requirement due to imperfect protection of privacy, lack of transparency in economic compensation, and the degradation of personal data after anonymization. A data exchange market system is examined where privacy is strongly protected via explicit entitlement combined with injunction remedy, and where the injunction can be bought at the market-determined price. Individuals can either protect their own privacy by not participating in the data market, or supply identifiable personal data in return for pecuniary compensation. The role of data brokerage firms which collect personal data, analyze them, combine one data set with another and eventually sell the output in the data exchange is emphasized. The shortcomings of current data protection laws are analyzed and the desirable revision of mydata industry is proposed.
