고가주택･다주택 중과세를 통한 주택시장안정의 허구성에 대한 헌법학적 일고찰

‘부족사회의 정신구조(tribal mentality)’와 조선시대 ‘군자’와 ‘소인’의 이분법은 지금 이 순간 ‘적폐’라는 이름으로 부활하여 ‘조세’라는 수단을 통해 고가주택 소유자와 다주택 소유자를 벌하고 있다. 사유재산권에 근거한 다수 개인들의 의사결정은 ‘시장’이라는 ‘자생적 질서’로 나타나기에 사회주의, 전체주의 국가에서 독재자의 선한 의도 보다 우월하다. 정권이 생각하는 선한 의도가 반드시 공익에 부합하는 결과를 가져오지 못함을 우리는 역사적으로 여러 차례 목도했다. 사회는 복잡하고 다양한 이해관계 속에서 기준이 생성되기에 정권이 추진하는 정책의 성공을 판단할 수 있는 유일한 기준은 ‘의도’가 아니라 ‘결과’다. 수 천만 명을 아사시킨 독재자 모택동과 유주택자, 무주택자 모두 도탄에 빠져 있는 현 정권의 정책 성공의 판단 기준은 ‘결과’뿐이다. 정권은 자신들의 가치관을 실현하기 위해 ‘조세’라는 막강한 권한을 행사한다. 그런데, 정책수단으로서의 부동산 조세 혹은 필요적 조세의 탈을 쓰고 있지만 실질적으로는 정권의 가치관 추진을 위한 도구로 사용되는 부동산 조세가 헌법상 국민의 재산권과 거주･이전의 자유를 명백히 침해한다면 이는 정부(보다 정확하게는 정권)가 조세라는 수단 통해 국민을 압살하는 반헌법적 정책일 뿐이다. 고가주택 소유자와 다주택 소유자에 대한 중과세는 합리적 차별성을 인정할 수 없는 과도한 조세이고 죄가 없음에도 정권이 생각하는 ‘적폐’이기에 벌하는 ‘징벌적’ 조세이며 더 나아가 정권(政權)이 개별 국민의 사유재산을 실질적으로 강탈하는 ‘약탈적’ 조세이고 사유재산권을 가진 국민을 정권이 조세라는 프레스로 짓뭉개는 ‘압살적’ 조세다. 이제 정권의 시장 생태계에 대한 조세를 통한 인위적 개입을 그치고, 단순한 선악의 이분법과 조선으로의 반동을 막아야 할 때이다.
Abstract
At the words of the dictator, tens of millions of people died of starvation. The ecosystem, which had been balanced by the self-sustaining order, thus took revenge on humans. The result of the government's excessive taxation is a simultaneous surge in housing and rental prices. Neither multi-homeowners, single-homeowner, nor the houseless are happy. But, it is only the government that is happy due to the increase in tax revenue that can be used as pleases. The success of the policies pursued by the government should be evaluated by ‘results’ rather than ‘intentions’. Neither individual people nor the government can fully understand the world. However, what can be certain is that the price generated by the ‘self-sustaining order’ of the market between individual economic actors is a far superior criterion than a few unverified values. The premise for the formation of a ‘self-sustaining order’ is private property rights, that every person has the right to own private property. Dictator Mao Zedong, as well as the current government of Korea, carried out policies by only his, or their, own values. But the simple dichotomy of good and evil couldn't solve the highly complex real estate market problems at all. If the value of goods are not recognized by the fair evaluation and contract of the ‘market’, it is inevitably determined by the king and the yangbans. Even under the guise of a ‘democratic republic’, if the government, including the president, ignores the self-sustaining order of the market and decides what is right or wrong, or what is valuable or not, that is totalitarianism and dictatorship. The current government does not recognize housing as a means of investment and therefore casually commits acts that shake the foundations of capitalism. What the current government want is the ‘vote’ of those who desire ‘punishment’ of wealthy persons for simply being wealthy. To be victimized by the government's wrong policies are the hard-won private property rights and the rights to freedom of movement and of residence. Now, it is hoped that there will be no more intervention on the self's balanced ecosystem by abandoning the simple dichotomy of ‘Gunja’ and ‘Soin’ and acknowledging the natural desires of individuals. Private property rights and the rights to freedom of movement and of residence are not fundamental rights that can be arbitrarily limited by a five-year contract government.
