동의의결제도의 활성화 방안 연구 - 일본 확약제도를 중심으로 -

2011년 12월 한미자유무역제도 이행을 위한 공정거래법 개정안이 국회를 통과하면서 우리나라에도 동의의결제도가 도입되었지만, 본래의 목적과 달리 장기간이 소요되는 등 문제점으로 인해 운용실적이 11년간 9건에 그치는 한계가 있었다. 온라인플랫폼, 모바일생태계 등 변화가 빠른 ICT 환경에서 신속하게 시장질서를 회복하고 피해를 구제하는 동의의결제도의 효율적 운영에 대한 필요성이 더욱 커지고 있고, 특히 우리나라 뿐 아니라 세계 각국에서 논의중인 온라인플랫폼법(안)에서 동의의결 제도를 적극적으로 검토중인 점에서 살펴볼 때 그동안 미진했던 우리나라의 동의의결제도의 문제점을 분석하고 신속히 개선해나갈 필요가 있다. 일본은 환태평양 경제 동반자 협정(Trans-Pacific Economic Partnership Agreement) 이행법안의 하나로 2018년 12월 확약(동의의결)제도를 도입하였는데, 제도 도입 3년간 8건의 확약이 이루어지는 등 초기부터 활발하게 활용되고 있다. 일본의 확약제도는 아직 시행 초기 단계이므로 제도의 장단점에 대한 평가를 내리기에는 다소 이르지만, 일본의 확약절차 및 8건의 동의의결 사례 등 일본의 확약제도를 검토하여 우리나라와 세계 주요국의 동의의결 제도 운영 현황에 비추어 시사점을 도출하고, 나아가 동의의결 제도의 활성화 논의에 대한 참고자료를 제시해보고자 한다.
Abstract
In December 2011, the consent decree system was introduced with the revision of the Fair Trade Act to implement the Korea-U.S. free trade system passed by the National Assembly. However, only 9 consent decrees were made final over 11 years and against the consent decree’s legislative intent because, among others, it took longer than expected from the consent decree application to the final consent decision. There is a growing need for the efficient operation of the consent decree system to swiftly restore market order and relieve damage as fast-evolving ICT environments such as online platforms and mobile ecosystems become prevalent. In particular, considering that the consent decree system is excpected to be adopted in proposed Online Platform legislation which is being discussed not only in Korea but also in other countries around the world, it is necessary to analyze and promptly improve the problems of the consent decree system in Korea, which has been insufficient. Japan introduced a consent decree (commitment) system in December 2018 as one of the implementations of the Trans-Pacific Economic Partnership Agreement, which has been actively used since the beginning, with eight commitments decisions made in three years. As Japanese commitment system is still in its early stages of implementation, it is too early to assess the pros and cons. However, by reviewing Japanese commitment system, including Japanese commitment process and eight cases of consent decrees, we would like to draw implications in light of the current status of the operation of the consent decree system in Korea and those in major jurisdictions around the world, and present further reference materials for discussions on the improvement of the consent decree system.
