초록
본 연구에서는 2021년 9월 1일부터 본격적으로 시행되고 있는 중국 「데이터보안법」의 주요내용을 살펴본 후, 이에 기초하여 중국이 데이터에 대해 어떤 인식을 가지고 있는지를 살펴보고 우리에 대한 간단한 시사점도 도출해 보았다. 먼저 중국은 데이터를 재산적 가치 내지 속성을 가지고 있는 담지체로 바라보고 있었으며, 이를 바탕으로 데이터에 대한 재산권화도 모색하고 있었다. 두 번째로는 데이터를 국가의 기본적인 전략자산으로 인식하고 있었는데, 등급별 분류 보호 및 보안심사 제도 등의 여러 제도들을 통해 데이터가 가지는 전략자산으로서의 가치를 뒷받침하고 있었다. 셋째, 중국 정부는 데이터를 국가안보에 대한 잠재적인 위협요인으로도 바라보고 있었는데, 데이터에 대한 이러한 인식은 디지털 권위주의의 구현으로 연결되고 있었다. 마지막으로 중국은데이터를 미ㆍ중간 과학기술 패권 경쟁에 있어서의 중요한 Game changer로 인식하고 있었는데, 「데이터보안법」 역시 데이터의 이러한 위상을 반영한 제도들을 잘 마련하고 있었다. 마지막으로 본 연구가 향후 데이터 분야에서의 대중 협력과 경쟁 모든 면에서 우리의 합리적 판단에 긍정적으로 기여할 수 있길 기대한다.
Abstract
This study aims to comprehend China’s stand on data by examining Data Security Act of PRC which has been in force since September 1, 2021, and to look for its implication. The results of this study is as follows. Firstly, Data is deemed something with property value and planned to be protected by property right. Secondly, China thinks of data as one of the crucial national strategic assets, and tries to maintain its values with some legal devices such as the categorized and hierarchical data protection system, the data security review system, and the export control measure etc. Thirdly, chinese government regards data as the potential threat to national security, this is related to digital authoritarianism. Fourthly, Data is considered as the important game changer of U.S.-China Competition in science and technology area. Finally it is hoped that this study can positively serve the cooperation and competition between Korea and China in the data industry field.
