‘스토킹처벌법’상 스토킹범죄 구성요건에 대한 비판적 고찰 - 최근 개정된 독일 및 오스트리아 형법 규정에 대한 검토를 겸하여 -

초록
스토킹이란 새로운 형태의 행위에 대한 개념이 정립된 이후 그 처벌 필요성에 대한 오랜 논의를 거친 결과, 최근 드디어 그 입법적 결실을 맺게 되었다. 이렇게 탄생한 스토킹범죄의 처벌 등에 관한 법률(이하 ‘스토킹처벌법’으로 약칭)이 2021년 10월 21일부터 시행된 이후 동법이 적용된 사례가 매우 많이 발생하고 있는 것을 보면, 이제는 스토킹범죄의 처벌 필요성보다는 제정된 법률을 어떻게 가다듬을 것인지에 논의의 초점을 맞춰야 한다. 스토킹의 범죄화를 부정적으로 바라보는 견해도 결국에는 그 구성요건이 명확하지 않다는 점과 그에 따라 가벌성이 확대될 수 있다는 점을 우려하고 있다. 그러므로 이러한 문제점을 최소화하면서 현실에 부합하게 개별 조항을 정리해 간다면, 헌법상 명확성 원칙을 준수하면서 동시에 피해자의 기본권을 두텁게 보호할 수 있게 될 것이다. 이러한 관점에서 봤을 때 스토킹처벌법이 스토킹행위와 스토킹범죄를 이원화하고 있는 방향성은 타당하다고 평가할 수 있다. 하지만 급격하게 변화하고 있는 온라인 공간에서의 범행양태를 제대로 반영하지 못하는 등 아쉬운 점이 발견되는 것도 사실이다. 따라서 그동안 처벌의 사각지대에 놓여 있던 새로운 범죄양태를 스토킹범죄의 구성요건으로 추가함으로써 체계적·통일적인 형사법적 대응을 모색해야 한다. 이와 관련하여 최근에 개정이 이루어진 독일 형법 제238조, 오스트리아 형법 제107조a 및 제107조c가 좋은 참고 사례가 될 수 있을 것이다.
Abstract
As a result of a long discussion on the necessity of criminal punishment for stalking in Korea, the Anti-Stalking Law has been in effect successfully since October 21, 2021. Therefore, the focus should now be on how to refine the enacted laws rather than the need to punish stalking crimes. If the problem that the elements of stalking crimes are not clear is eliminated and each provision is revised to suit reality, it will be possible to protect the victims while complying with the constitutional clarity principle. From that point of view, it is reasonable that the Anti-Stalking Law distinguishes acts of stalking from stalking crimes. Only continuous and repeated execution of acts of stalking constitutes stalking crimes. However, there are problems such as not properly reflecting various types of crimes committed on the Internet(so-called cyberstalking). Therefore, it is necessary to seek a systematic and unified criminal response by including new types of crimes that have not been punished so far in the elements of stalking crimes. To this end, Articles 238 of the German Criminal Act, 107a and 107c of the Austrian Criminal Act, which were recently revised, can be referred to.
