The effects of citations from rejected patents on the renewal of cited patents - A case study on the Patents in IT Methods for Management

록- 전자상거래 특허 사례주시형* 특허 인용 정보는 기술혁신과 관련한 다양한 분야의 연구에서 활발하게 활용되어 왔다. 그러나 선행연구들은 등록된 특허로부터의 인용 정보를 활용하는 것에 집중하였으며, 거절된 특허로부터의 인용 정보는 활용되지 않았다. 출원된 특허 중 상당수가 등록되지 않고 거절되는 측면을 고려하면, 특허 인용 정보를 활용한 연구에서 등록된 특허로부터의 인용 뿐만 아니라 거절된 특허로부터의 인용을 포함하여 분석할 필요가 있다. 이에 본 연구에서는 특허의 거절율이 가장 높게 나타나는 전자상거래 분야 특허에 대해 등록된 특허로부터의 인용 정보 와 함께 거절된 특허로부터의 인용 정보를 활용하여 거절된 특허로부터의 인용이 피인용 특허의 갱신에 유의한 영향을 미치는지, 그리고 인용 특허의 등록/거절 여부에 따라 피인용 특허의 갱신에의 영향에 차이가 있는지 살펴보았다. 분석 결과, 등록된 특허로부터의 인용뿐만 아니라 거절된 특허로부터의 인용 또한 피인용 특허의 갱신에 유의한 긍정적 영향을 미치는 것으로 나타났으며, 등록된 특허와 거절된 특허로부터의 인용이 피인용 특허의 갱신에 미치는 영향의 크기에는 유의한 차이가 없는 것으로 나타났다. 이러한 결과는 특허 인용 정보를 활용한 연구에 있어 기존에 잘 활용되지 않았던 거절된 특허로부터의 인용 정보의 활용이 요구됨을 보여준다.
Abstract
Patent citations have been widely utilized in various fields of innovation study. However, the patent citations from rejected patents have rarely been utilized. Considering that a significant number of patent applications are rejected, researches that utilize patent citations need to utilize citations from rejected patents as well as those from registered patents. This paper investigated the effects of citations from both registered and rejected patents on the renewal of patents in IT methods for management field, which have lowest patent registration rate. It is found that (1) not only the citations from registered patents but also that from rejected patents have significant effects on the renewal of cited patents, and (2) the difference in the magnitude of effects between the registered and rejected patents is insignificant. It shows the necessity of utilizing citations from rejected patents in innovation studies.
