공물법과 행정절차 - 공물의 설치에 관한 법제의 체계 -

The purpose of this study is to illuminate public domains law from the point of view of administrative procedures. The public domain refers to an object publicly provided by the administration after acquiring the title, and with a special expression of intention about it. In order to establish public domains, ⒜ even if the administration does not necessarily need to acquire ownership, the consent of the owner or other right holder is required for public provision. ⒝ A public offering must be made, and ⒞ there must be an expression of intent. Although these conditions are satisfied through administrative procedures, administrative procedures do not proceed in the order of conceptual composition. Therefore, this study divides the administrative procedure for establishment of public domains into four stages, namely, administrative planning, project planning, compulsory acquisition and public burden, and analyzes how the conceptual composition of public domains is realized at each stage. For a systematic analysis, the French and German legal systems, which are models of korean public domains law, are comparatively studied.
