국가안보 차원에서의 외국인투자 규제에 관한 연구 - 독일과의 비교를 중심으로 -

Today, the world is strengthening its screening of foreign investment for national security purposes. The EU is also enacted as an FDI regulation to enable a unified and strengthened foreign investment review by EU member states. Based on this, Germany includes not only the defense industry but also major infrastructure, high-tech, and sensitive information as well as foreign investment in order to maintain security and public order. Furthermore, as a criterion for examination, it not only examines the actual threats and possibilities that will affect the maintenance of security and public order, but also stipulates that foreign investors can be reviewed. Germany is a member of the EU and is an advanced country in an important position in the global economy, and EU laws play a leading role in world norms. The current trend of regulating foreign investment in order to maintain security and public order in the EU and its member country Germany is very important in terms of legislation. Korea also needs to protect Korea’s core technologies, industries, and companies in order to maintain security and public order. However, Korea’s foreign investment-related laws are insufficient in terms of security and protection as they focus on promotion, and this paper suggested the direction in which Korea’s foreign investment regulations should proceed through comparison with Germany’s AWG and AWV.
