부당해고의 불법행위책임론적 구제법리

초록
이 논문은 불법행위책임론에 근거한 부당해고 구제법리의 포괄적 구성 을 시도한 것이다. 미국 노동법상 부당해고의 불법행위책임론적 구제법 리를 소개하고, 거기에서 시사점을 얻어 손해배상에 한정되고 해고무효 법리에 종속되는 형태로 전개된 기존의 법리를 비판하고 새로운 법리를 구성하였다. 부당해고의 불법행위책임론적 구제로 손해배상 뿐 아니라 이른바 injunction(구제명령)에 해당하는 복직명령이 인정됨을 법이론적으로 논 증하였다. injunction(구제명령)의 종류를 유형화하고 이에 따라 요건을 체 계화하였다. 손해배상이 정신적 손해배상뿐만 아니라, 복직명령을 선택하 지 않는 경우 장래손해배상, 신뢰손해배상 등도 인정됨을 논증하였다. 부당해고의 불법행위책임론적 구제는 부당노동행위, 보복적 해고, 차별 적 해고 등에 적용됨을 논증하였다. 이와 관련하여, 특별 해고제한규정이 지니는 중요한 의의를 해명하였고, 특별 해고제한규정을 유형적으로 정 리하였다. 일반 해고제한규정 위반 해고에 대해서는 불법행위책임론적 구제가 배 제됨을 논증하였다. 이에 따라 노동위원회의 해고 구제는 채무불이행책 임론적 구제법리에 의해야 함을 논증하였다. 정신적 손해배상에 한하여 부당해고의 불법행위책임론적 구제를 인정하던 대법원 판례법리를 비판 하였다. 부당해고의 불법행위책임론적 손해배상의 범위를 확장시킨 새로 운 대법원 판례도 비판적으로 검토하였다. 부당해고 무효법리, 부당해고의 채무불이행책임론적 구제법리, 부당해 고의 불법행위책임론적 구제법리의 관계를 검토하고, 포괄적 해고제한법 의 입법 필요성을 제기하였다. 조직· 단체론적 부당해고 구제법리 구성 문제를 추후 연구과제로 제기하였다.
Abstract
This thesis attempts to compose a comprehensive legal theory of unfair discharge remedies based on the tort liability. I introduce the legal theory of unfair discharge remedies based on the tort liability under the US labor law, and from there, criticize the existing legal theories that are limited to damages and subordinated to the legal theory of discharge invalidity, and constitute a new legal theory. It was argued theoretically that the reinstatement order corresponding to the injunction, as well as damages, was recognized as remedies based on the tort liability theory of unfair discharges. The types of injunctions were categorized and their requirements were systematized accordingly. It was argued that not only emotional damages but also future damages and reliance damages are recognized if the reinstatement order is not chosen. It was argued that the legal theory of unfair discharge remedies based on the tort liability applies to unfair labor practices, retaliatory discharges, and discriminatory discharges. In this regard, the important significance of the special clauses on discharge restrictions was clarified, and were tangibly organized. It was argued that the legal theory of unfair discharge remedies based on the tort liability was excluded for discharges in violation of the general clause of discharge restrictions. Accordingly, it was argued that the remedies for discharge by the Labor Relations Commission should be based on the legal theory of remedies based on default liability. I criticized the case law of the Supreme Court, which recognized the legal theory of the unfair discharge remedies based on the tort liability only for emotional damages. The new Supreme Court precedent that expanded the scope of damages based on tort liability theory of unfair discharge was also critically reviewed. The relationship between the invalidity theory of unfair discharges, the legal theory of remedies based on default liability of unfair discharges, and the legal theory of remedies based on the tort liability of unfair dischares was reviewed, and the necessity of enacting a comprehensive legislation on discharge restrictions was argued. The problem of organizational and collective theory of unfair discharge remedies was raised as a future research project.
