松潤 姜求哲 敎授 행정법학의 성과와 경향적 특성

This article is a a memorial paper for the 1st anniversary of Prof. Song Yoon Kang Gu Cheo. Professor Kang Gu Cheol was born in 1946 and died in 2020. He graduated from Law School in Kookmin University. He obtained his Juris Doctorate from Myongji University in 1986 with 『A Study on the National Compensation System』. After becoming a professor of law at Kwandong University in 1980, he served at the Law School of Kookmin University in 1986, where he retired. His representative books include 『Lecture Administration Act I』 and 『Lecture Administration Act II』, and he left about 50 major research papers. He played a central role in the founding of ‘the East Asian Administrative Law Society’, and contributed to reforming the legal system of Mongolia after a socialist country by introducing Korean law to Mongolia. The characteristics of Prof. Kang's administrative law is evaluated as ‘balance and practicality’ in both theory and reality. He made special contributions to the development of Korean administrative law in fields such as the theory of national compensation from the point of view of the rule of law, land public law, and the system for securing administrative obligations. He diagnosed the academic situation of Korean administrative law at the time when he was actively conducting academic activities as a complex and fluid state in which the old and new theories mixed and coexisted. Professor Kang Gu Cheol reviewed the existing theories based on these diagnoses and attempted to make new theories suitable for reality. Therefore, his administrative law was active in the expansion of new administrative forms based on open comparative public law. Analyzing his books and research papers written at such a time, the characteristics of his administrative law can be summarized as realistic administrative law, legislative policy-oriented administrative law, and human rights-oriented administrative law. Although there are many research papers on administrative law dogmatics in Professor Kang's Administrative Law, there are many papers that participated in the academic debate at the time and pioneering papers that were not discussed in administrative law. Professor Kang Gu-cheol has been devoted to learning all his life, but has maintained a scholarly attitude that does not turn away from reality. It is no exaggeration to say that this is a symbol of a modern scholar. He had an open personality that embraced everyone and communicated with anyone. It is the responsibility of our descendants to faithfully inherit and develop his spiritual and academic achievements.
