한국의 난민제도의 문제점과 개선방안에 대한 연구 -난민 불복 소송 판례 분석을 중심으로-

As an aid donor, South Korea provides funding worth 1 trillion won every year. South Korea has restrictions on the acceptance of refugees despite being the first country in Asia to ordain the Refugee Act. The average refugee recognition rate is only 2.8% in South Korea. This study analyzes the reasons for the low refugee recognition rate, examines the problems of the current refugee system in South Korea, and suggests ways to improve them through analyses of the administrative agency's decision not to utilize the refugee status screening process and of the legal cases of refugees appealing against the rejection of refugee status. The administrative agencies believe that the number of fake refugees abusing the refugee system has been increasing since the enactment of the Refugee Act. As claimed by the administrative agencies, there are cases in which refugee applications are abused to extend the period of stay or engage in profit-making activities. However, the problem is that a decision is made to reject refugee recognition on the grounds of insufficient evidence or unclear purpose of entry although refugee requirements are otherwise met. The administrative agencies must thoroughly filter out false refugees. Nevertheless, it is necessary to consider whether they filter out refugees who genuinely need protection.
