규제자유특구의 법제 개선방안 연구

세계경제는 4차 산업혁명에 따른 융･복합 기술의 등장으로 산업간 경계가 모호해지고 새로운 기술･서비스가 빠르게 창출되고 있다. 반면, 우리나라의 경우 신기술분야 관련 법제의 미비, 칸막이 규제, 포지티브 규제시스템 등으로 융복합 신제품·서비스의 사업화 및 시장출시에 애로가 많이 발생하고 있어 정부의 제도개선 노력이 절실히 요구되는 상황이다. 이에 신기술 사업화를 위해 규제샌드박스 제도가 2019년 1월 시행되었으나 규제샌드박스 시행의 성과를 보다 일반적인 규제개선으로 연결시킴으로써 성과를 확산하기 위한 전략은 아직 미흡한 상황이다. 특별히 규제특례 수혜기업의 대다수가 중소기업이라는 점에서 중소벤처기업부의 규제자유특구 제도의 개선 방안이 마련이 요구된다. 이에 본 연구는 규제자유특구의 제도적 특성과 운영 현황을 분석하고, 규제자유특구의 성과가 일반적인 제도 개선으로 확산될 수 있는 방안을 제시하였다. 연구 결과, 규제자유특구의 적용 범위, 규제자유특구의 지정 및 변경 관련 규정, 규제자유특구 지정해제 관련 규정 관련 개정 사항이 도출되었다.
Abstract
In the global economy, with the advent of convergence and complex technologies following the 4th industrial revolution, the boundaries between industries are blurring and new technologies and services are rapidly being created. On the other hand, in Korea, there are many difficulties in commercialization and market launch of convergence new products and services due to the inadequacy of laws related to new technologies, partition regulation, and positive regulatory system. Accordingly, Korean government introduced the regulatory sandbox system in January 2019 to commercialize new technologies, but the strategy to spread the results by connecting the performance of the regulatory sandbox implementation to more general regulatory improvement is still insufficient. In particular, the Ministry of SMEs and Startups needs a strategy to improve the Special Regulatory Free Zones (SRFZ) in that the majority of companies that benefit from special regulations are small and medium enterprises. Therefore, by analyzing the institutional characteristics, operational status, and legal issues, this study suggested improvement measures for the SRFZ.
