시민주도형 헌법개정절차 - 헌법개정 절차의 민주적 구성을 위한 사례 분석 -

This article tries to open the possibility of a new constitutional system that overcomes the limits of the 1987 constitutional system by preparing a constitutional amendment procedure in which the "We, the Korean people“ become the actual subjects of this polity. It points out the limitations of the 1987 constitutional system, which were revised without substantial participation of citizens, and explains why the demand for constitutional amendment rapidly erupted after the candlelight rally of 2016. In addition, the cases of Iceland, Ireland, or Chile, where the Crowd-Sourcing constitutional amendment procedures were/are carried out, were analyzed to find optimal constitutional amendment procedures out that could meet these national constitutional amendment demands. In these cases, the constitutional amendment process is not just a legislative action that projects the political power relations fixed at the moment, but has laid a framework for creating and constructing the constitutional will of the people more dynamically and integrating it in the form of a constitutional war. This article concludes with some lessons for proper procedures to amend our constitution from the cases of those countries, from which more democratic and participatory constitution can be construed.
