EU의 대테러리즘에 대한 법제 검토

초록
조직범죄라는 개념은 근래에 사용된 것이 아님에도 불구하고 독일에서는 30년 동안 그 개념에 대한 법률상의 논의가 이어져 왔는데, 이는 범죄단체의 조직을 둘러싼 국제 전략을 논하지 않고서는 조직범죄가 무엇을 의미하는지 명확히 밝히는 데에 도달할 수 없다는 것을 의미한다. 왜냐하면 각 국가마다 다른 법체계와 문화의 차이는 그 국가의 형사실체법에서 차이가 나고, 이는 당연히 개념의 차이를 가져오는 것이기 때문이다. EU에서 Europol은 2개국 이상의 회원국에 영향을 주는 중대한 범죄를 방지하거나 이에 대처하기 위해 회원국 경찰 기관의 활동이나 상호협력을 지원·강화 하는 것을 목적으로 하는 EU의 기관으로 회원국 또는 제3국으로부터 정보의 수집, 보관, 처리, 분석 및 교환을 그 임무로 하고 있다. Europol 대상이 되는 범죄는 조직범죄, 테러리즘, 약물거래, 돈세탁, 인신매매, 사이버범죄 등과 같이 그 행위 규제의 폭은 넓지만, 범죄 혐의자에 대한 체포나 신체구속의 권한은 갖고 있지 않다. 처음에는 Europol 마약 대책실로 출범하여 Europol 설치 협정(1995년 서명, 1998년 발효)에 의해 범죄의 대상 범위가 확대되었고, 그 후 2009년에 채택된 EU 이사회의 결정(2009/371)/JHA)에 따른 EU 예산에 기초한 기관이 되었다. 이 이사회 결정에 대한 새로운 규정안이 2013년 3월 27일에 유럽위원회에서 제출되었고, 2016년 5월 11일에 성립되어 2016년 5월 24일 관보에 공포되었으며, 2016년 6월 13일에 발효되어, 경과규정을 제외하고 2017년 5월 1일부터 시행되었다. 이 규정에 따라 Europol은 유럽의회와 EU 이사회가 공동으로 정한 새로운 법적 틀 아래에 놓이게 되었다. 이 규정은 13장 77개조로 이루어져 있는데, Europol의 정보교환의 구심점으로서 기능 강화, 유럽 의회 및 회원국 의회의 감독 참여, 개인정보보호 강화를 내용으로 하고 있다.
Abstract
There is no single law related to the search for missing persons in Japan. Therefore, the 「Act on the Protection and Support of Missing Children, ETC.」 has not been prepared for missing children like Korea. However, as the basis for the search for missing persons, it is legislated in a way that regulates the missing persons, such as missing adults and children, without distinguishing them. In other words, the 「Rules on Missing Persons Discovery Activities」, a rule of the National Public Safety Commission, directly stipulates the procedures for searching for missing persons, and each local government has enacted and implemented ordinances and ordinances to interpret and operate these rules. In addition, the 「Police Act」, 「Enforcement Decree of the Police Act」, 「Enforcement Rules of the Police Act」, and 「Ordinance of the National Police Agency Organization」 are located as laws based on the 「Enforcement Rules on Missing Persons Discovery Activities」. Japan's missing person search system differs from Korea's missing person search system in the definition of a missing person, the status of the search and investigation for the missing person, registration of information on the missing person information system (profiling), and provision of location information, and at the same time provides implications.
