AI시대에서 사회적 범죄예방을 위한 형법의 적용방안

초록
AI시대는 인간과 AI(인공지능 로봇)가 공존하는 사회라고 할 수 있다. 그리고 AI의 역할과 기능변화에 따라 사회적 구조체계가 재편될 수도 있다. 그렇다고 하더라도 AI는 인간에 의하여 발명되고, 인간에 의하여 진화된 피조물에 불과하다. 그래서 AI는 인간보다 우위에 있을 수 없는 존재이다. 즉 AI는 주된 인간에 의하여 그에 종속된 인간의 피조물로서 인간생활의 보조적 도구로써 활용되기 때문이다. 그렇지만 향후 AI는 인간의 능력을 초월할 수 있는 고도의 강(强) 인공지능을 장착할 수도 있기에 그에 따른 역기능을 우려하지 않을 수 없다. 이러한 측면에서 본 연구에서는 AI시대를 맞이하여 인간과 AI 사이에 관련된 갈등과 각종 사회적 범죄 등을 체계적으로 예방하고자 합리적인 방안을 제시하고자 한다. 주지하는 바와 같이 AI시대는 인간에 의한 범죄와 AI에 의한 범죄, 인간과 AI가 함께 연루된 범죄 등이 복잡다단하게 발생할 가능성이 상존(常存)한다. 그러므로 사전에 사회적 구조체계에서 AI의 범죄예방을 위한 셉테드(CPTED)의 적용방안과 사회적 윤리규범의 표준화 작업을 통하여 AI의 알고리즘에 내장하여 범죄제어시스템을 활성화하는 방안을 제안하고자 한다. 왜냐하면 AI시대라고 하더라도 AI를 통제하고, 제어하는 몫은 사회적 정의로서 인간의 몫이기 때문이다. 따라서 AI범죄를 예방하기 위하여 인간에게는 예방목적으로서 미래지향적 예방형법을 적용하여야 하고, AI에게는 인간을 초월하는 사회적 윤리규범의 준수를 활성화하는 알고리즘의 내장과 셉테드(CPTED)의 기법을 활용하여 범죄예방시스템을 운용하는 기술적 예방체계를 선제적으로 확립하는 것이 바람직하다.
Abstract
The AI era can be said to be a society in which humans and AI (artificial intelligence robots) coexist. In addition, the social system structure may be reorganized according to changes in the role and function of AI. Even so, AI is nothing more than a creature invented by humans and evolved by humans. Therefore, AI cannot be superior to humans. That is, AI is a subordinate tool of human life as a human creature subordinated to it by the main human being. However, in the future, AI may be equipped with advanced artificial intelligence that can exceed human capabilities, so we cannot help but worry about its adverse function. In this regard, this study intends to suggest a reasonable way to systematically prevent conflicts and various social crimes related to humans and AI in the AI era. As is well known, in the AI era, there is always a possibility that crimes caused by humans, crimes caused by AI, and crimes involving humans and AI will occur in a complex and complex way. We would like to propose a way to activate the crime control system by embedding it in the AI algorithm as a way to apply (CPTED) and standardize social ethical standards. This is because, even in the AI era, it is the human responsibility to control and control AI as social justice. Therefore, in order to prevent AI crimes, the future-oriented preventive criminal law should be applied to humans as a preventive purpose, and to AI, the built-in algorithm that activates the observance of social ethical standards that transcends humans and the technique of CPTED are used to prevent crime. Therefore, it is desirable to preemptively build a technical prevention system for crime prevention.
