국가안보를 위한 국가핵심기술 관리의 실효성 확보 방안

현재 국가차원에서 국가안보를 목적으로 기술을 보호하고 있는 기술에는 국가핵심기술, 방위산업기술, 국가첨단전략기술 등 매우 다양하다. 그중 국가 차원의 보호가치가 높은 기술이자 국가 경제의 근간에 위협이 될 수 있는 기술인 국가핵심기술은 이와 같이 다양한 기술 중 핵심이 되는 기술이라 볼 수 있다. 이러한 국가핵심기술은 「산업기술보호법」에 근거하여 다양한 제도를 통해 보호되고 있고, 이는 향후 점차 늘어가 예정이다. 그러나 국가핵심기술의 유출은 계속해서 진행되고 있고, 그 수법은 점차 다양해지고 있어 이에 대응하기 위한 국가, 민간단체, 기업 등의 노력이 요구되고 있다. 그러나 현재 「산업기술보호법」에서 규정하는 기술 보호 및 관리는 국가핵심기술 보유·관리 대상기관의 활발한 협조를 유도하지 못하고 있고, 기술 보호 및 관리과 효과적으로 이루어지고 있다고 보기 어려운 실정이다. 이에 본 논문에서는 「산업기술보호법」에 근거한 국가핵심기술의 보호 및 관리를 위한 다양한 의무 및 제도들이 실질적이고, 효과적으로 기술의 유출방지 및 보호를 달성하고, 이를 통해 궁극적으로 실효성 있는 국가안보로 나아가기 위한 보호 방향에 대해 제안하겠다. 먼저, 국가 차원의 보호가 필요하다고 판단되는 품목을 정하여 국가핵심기술과 함께 관리하여 나간다. 그리고 국가핵심기술 보유기관 등록제와 연계하여 국가핵심기술 보유기관으로 등록된 대상기관과 등록되지 않은 대상기관에 차이를 두어 국가핵심기술 보유기관 등록제를 활성화하여 국가핵심기술에 대한 국가의 관리 및 감독을 원활히 하게 한다. 마지막으로 「산업기술보호법」에 국가핵심기술 보유·관리 대상기관에 대한 지원규정을 마련하여 기술개발에 대한 지원과 국가핵심기술의 보호가 함께 이루어질 수 있게 한다. 이를 통하여 국가안보를 목적으로 「산업기술보호법」상 기술의 유출방지 및 보호를 위한 대응이 보다 효과적으로 이루어질 수 있으리라 판단된다.
Abstract
Among the various technologies that regulate the prevention and protection of technology leakage for national security purposes, National Core Technology is a technology with high protection value and can pose a threat to the foundation of the national economy. This is protected through various systems based on the "Act on Prevention of Divulgence and Protection of Industrial Technology", which is expected to increase gradually in the future. However, the leakage of National Core Technologies continues, and the methods are gradually diversifying, requiring efforts from the state, private organizations, and companies to respond to them. However, it is difficult to say that the current technology protection and management stipulated in the "Act on Prevention of Divulgence and Protection of Industrial Technology" does not induce active cooperation from institutions subject to the possession and management of National Core Technology, and is effective in technology protection and management. In this paper, various obligations and systems for the protection and management of National Core Technology based on the "Act on Prevention of Divulgence and Protection of Industrial Technology" are intended to substantially and effectively prevent leakage and protect technologies. And through this, I will propose a direction of protection to ultimately move toward effective national security. First, items that are judged to need the protection of the national vehicle are determined and managed together with the National Core Technology. In addition, by utilizing the registration system of institutions with National Core Technology, the government will encourage institutions subject to the ownership and management of National Core Technology to participate in the event. Finally, the "Act on Prevention of Divulgence and Protection of Industrial Technology" prepares support regulations for institutions subject to the possession and management of National Core Technology so that support and protection for technologies can be achieved together. Through this, it is judged that the response to the prevention and protection of technology leakage under the "Act on Prevention of Divulgence and Protection of Industrial Technology" for the purpose of national security can be made more effectively.
