공동발명자 사이에 (객관적 기여 외에) 주관적 의사소통이 반드시 필요한지 여부에 관한 연구

공동발명자를 판단하는 법리와 관련하여, 기존의 다수설은 청구항으로 특정되는 발명의 특징적 구성요소에 실질적 기여가 필요하다는 ‘객관적 기여’의 요건 외에 공동발명자 사이에 주관적 의사소통이 필요하다는 ‘주관적 협력’의 요건을 요구한다. 이 글은 ① 그 경직된 법리가 다종다양한 연구개발의 행태가 존재하는 현실을 반영하지 못하는 것이라고 주장하며, 나아가 ② 쌍방(two-way) 인지(認知)가 존재하지 않아도 일방(one-way) 인지만 존재하여도 주관적 협력의 요건이 충족되어야 한다는 점, ③ 모인된 후 변경된 발명에서 공동발명자를 판단하는 경우, 모인자가 피모인자의 또는 적어도 피모인발명의 존재를 인지한 경우, 모인자와 피모인자의 연결, 상호작용 또는 일방 인지를 인정해야 한다는 점을 주장한다. 이 글은 이러한 법리의 정립을 위하여 추가적으로 다음을 주장한다: ① 출원서, 직무발명신고서 등에 기재된 발명자 기재가 바른 것으로 추정하는 법리를 정립해야 한다는 점, ② 공동발명자를 정의하는 규정을 특허법에 신설해야 한다는 점, ③ 그 규정이 직접적 협력관계 외에 간접적 협력관계에 의해서도 공동발명자 관계가 형성될 수 있음을 분명하게 해야 하는 점.
Abstract
With regard to the jurisprudence to decide joint inventors, the majority opinion demands not only objective dedication requirement (whether there is substantial dedication on distinct element of an invention) but also subjective collaboration requirement (whether there is subjective communication among joint inventors). This paper proclaims that (1) such rigid jurisprudence does not reflect various research situations, (2) subjective collaboration requirement be also complied with when there is one-way knowledge, (3) in a case where joint inventorship is being determined after an invention was derived and modified, if the modifier knew existence of the original inventor and/or invention, one-way knowledge shall be admitted. In order to establish such jurisprudence, this paper further proclaims that (1) we settle such jurisprudence under which inventor names written in a patent application shall be presumed as correct, (2) we make a new provision which defines joint inventorship, and (3) the new provision clarify that not only direct collaboration but also indirect collaboration may establish joint inventorship.
