헌법상 공화개념의 현대적 해석에 관한 소고

초록
우리 헌법 제1조 제1항은 ‘대한민국은 민주공화국’이라고 선언하고 있다. 이는 제헌 헌법 이래 일관성 있게 추구하며 지키고자 했던 국가 형태에 대한 근본정신이다. 헌법은 공동체의 존속과 구성원들의 행복추구를 보장하기 위하여 세워진 국가라는 공동체와 공동체 구성원의 삶에 관한 틀과 질서를 정하는 규범으로, 우리 헌법은 ‘민주공화국’을 추구하고 있다. 국가운영 철학도 이러한 헌법정신과 함께 해야 한다. 공화국은 ‘모두의 나라’여야 한다는 원의로부터 시작되지만, 모두의 나라가 무엇인지, 어떻게 될 수 있는 것인지 그리고 그 하위의 내포 개념에 대해서는 다양한 생각들이 표출될 수 있기 때문에, 정치공동체 속에서 현재 우리의 문제점이 무엇인지, 이에 대하여 민주공화국의 이념으로 어떻게, 어느 범위에서 대응할 수 있는지, 이를 우리사회가 어떻게 합의할 수 있는지는 중요한 문제이다. 본 논문에서는 공화주의의 의미의 정확한 의미와 오늘날 함의하는 바를 보다 구체적으로 분석하여 공화개념의 헌법해석과 발전방향을 검토하였다. 공화국원리에 관한 헌법 담론이 헌법해석을 풍부하게 해주는 것은 부인할 수 없다. 이를 통해 ‘전체주의적’ 공화국을 경계하고, 헌법 제1조에서도 선언하고 있는 것처럼, ‘민주’공화국의 의미를 끊임없이 고민하고 그 담론을 헌법해석에 적용하는 것은 우리헌법 발전에 있어 중요한 의미를 가진다고 본다.
Abstract
Article 1, Paragraph 1 of our Constitution declares that “Korea is a democratic republic”. This is the fundamental spirit of the state form that has been consistently pursued and maintained since the first Korean Constitution of 1948. The Constitution is a norm that sets the framework and order for the life of the community and community members of the state, which was established to ensure the survival of the community and the pursuit of happiness of its members. Our Constitution pursues a ‘democratic republic’. The national operating philosophy must also be in line with this Constitutional spirit. Although the republic begins with the will to be a ‘nation for all’, various ideas can be expressed about what a country for everyone is, how it can be, and its subordinate concepts. It is an important issue how and to what extent we can respond to these problems with the ideology of a democratic republic, and how our society can agree on them. This article examines the Constitutional interpretation and development direction of the republican concept by analyzing the precise meaning of republicanism and its today’s implications in more detail. It cannot be denied that the Constitutional discourse on the principle of the republic enriches the interpretation of the Constitution. As we are wary of a “totalitarian” republic and declared in Article 1 of the Constitution, it is important to constantly ponder the meaning of a “democratic” republic and apply that discourse to the interpretation of the Constitution.
