탐정사법 입법정책 방향에 관한 연구 — 변호사법 제109조 제1호를 중심으로 —

Sub-paragraph 1 of Article 109 of ATTORNEYS-AT-LAW enumerates the general and comprehensive Article 3. The scope of lawyers' job covers legal services and mediations, which means that their services are very comprehensive. After all, every issue of our society would lead to a law problem, and in this regard, various legal cases could be handled only by lawyers. As such, ATTORNEYS-AT-LAW stipulates that every legal service should be provided by lawyers, while allowing other certified specialists like judicial scrivener by means of individual laws to provide for the limited legal services. All in all, the current legal mechanism supports lawyers' monopolistic legal services. However, their legal services are much overlapped by the services provided by legal scriveners, administrative agents and other specialists. In particular, private detectives' jobs such as ‘investigation into facts and collection of data’ would well violate ATTORNEYS-AT-LAW, and therefore, private detectives could not positively be engaged in their services, which means that citizens' rights to select the legal services or accede to the judicial services are limited excessively. Hence, this study addresses the problems of Paragraph 1 of Article 109 of ATTORNEYS-AT-LAW and thereby, suggests some directions for legislation of a private detective law ensuring citizens' rights to get an effective legal services in their ordinary life.
