교회법전 제6권의 개정에 따른 교회 형법의 변화 연구

When Pope Benedict XVI was in office, the Catholic Church judged that it was difficult to recover from the damage and scandal resulting from the crime with simple recommendations and persuasion. When Pope Francis was in office, the Apostolic constitution 「Pascite Gregem Dei」 was promulgated on May 23, 2021 and the penal law for the church (Book VI of the Code of Canon Law) was revised. This study is to examine the legislator's intention to revise through comparative analysis with past norms. Therefore the intention of the revision is to clearly realize the purpose of punishment, for the amendment of the offender, the restoration of justice and the reparation of scandal. For example, the severity of the punishment has been emphasized: Pastor’s proper and prompt measures, the vagueness doctrine, the act of aggravated punishment, the principle to impose together punishments, the suspension extended to all believers, certain crimes with an extended prescription, and the imputable criminal and the Ordinary with the solidarity. In addition, systems have been added to ease the strictness and to be applied with canonical equity: the presumption of innocence, the principle of proportionality, mercy and amendment for the offender, the compensation for damages, and ethical compensation.
