제4차 산업혁명의 도래와 미래도로환경변화에 따른 도로교통법 진단 및 입법전략 방향

현 도로교통법은 1961년 제정 이후 2번의 전면 개정이 있었지만 교통과 관련한 사건의 발생과 당해 사건에 대한 사회적 관심에 따른 소극적인 개정이 주를 이루었다. 이에 따라 현재 제4차 산업혁명으로 대표되는 현상으로 말미암아 등장하고 있는 도로환경변화에 능동적인 대응을 도모하고 있다고 보이지는 않는다. 도로교통법은 운전이라는 행위와 이와 관련된 행위를 규율하고 나아가 도로교통 안전이라는 입법목적을 가지고 안전한 도로교통을 위하여 실제로 봉사하고 있는 법률이라는 사실을 부인할 수는 없다. 그렇지만 제4차 산업혁명시대의 도래는 현재의 도로환경을 본격적으로 변화시킬 것이라는 점을 고려한다면 이제는 변화하는 도로환경에 대한 보다 적극적이고 탄력적인 대응이 요구된다는 점을 인정하여야 한다. 사실 도로교통법은 지금까지 교통사고의 발생으로 인한 인명 손실 그리고 사회적 관심의 증폭으로 말미암아 여론을 반영한 단지 소극적인 개정만을 고집하여 왔다는 점에서 도로교통법이 현재의 상황에 대하여 기민한 대응을 본격적으로 도모하고 있다는 평가를 내리는 것은 어려운 것이 사실이다. 제4차 산업혁명의 본격적인 도래에 따라 앞으로 닥칠 도로환경 변화에 실효적으로 대처하기 위해서는 도로환경 변화에 대한 보다 근본적인 성찰이 있어야 함은 물론이고 이를 전제로 보다 다각적이고 실제적인 입법전략과 정책이 마련되어야 하는 것이다. 다만 이는 입법형성권의 문제라는 점에서 헌법적합성의 문제가 아닌 가치판단의 문제이고 바람직한 수준에서의 입법방향이 중요하다는 점에서 비교법적 논의의 중요성을 인정할 수 있다. 특히 캘리포니아 주 자동차법(California Vehicle Code (CVC))에서 정하고 있는 행위유형의 다각화 및 규제의 실효성 도모, 도로환경의 변화에 대응하기 위한 다각적 정책 마련 및 방향성 설정 그리고 다양한 교통수단에 대한 명확한 개념 제시 등의 사항은 제4차 산업혁명의 도래에 따라 본격화되고 있는 도로환경의 변화에 대응하기 위한 사항인데 이 역시 우리 도로교통법의 개정 작업에 충분히 참고할 수 있다고 생각된다.
Abstract
The current 「Road Traffic Act」 has been wholly revised twice since its enactment in 1961, but it is true that it was a passive revision due to the occurrence of traffic-related events and social interest brought about from the events. In particular, it does not seem to be actively responding to abrupt changes in the road environment that are currently emerging as an important situation represented by the 4th Industrial Revolution. It cannot be denied that 「the Road Traffic Act」 regulates the act of driving and related acts, and furthermore, the Act actually serves safe road traffic with the legislative purpose of road traffic safety. However, considering that the advent of the 4th Industrial Revolution will change the current road environment in earnest, it should be acknowledged that more active and flexible responses to the changing road environment are necessary. In fact, it is difficult to speculate that 「the Road Traffic Act」 is pursuing a quick response to the current situation of the 4th Industrial Revolution in earnest, given that 「the Road Traffic Act」 has been revised passively reflecting public opinion after mortality events caused by traffic accidents. In order to effectively cope with future road environment changes with the advent of the 4th Industrial Revolution, much more fundamental reflections ans discussions on road environment changes must be made, and more diverse and practical legislative strategies and policies must be discussed and prepared. Based on those issues, the importance of comparative legal discussions can be recognized in that the matter of revision of legislation is the that of legislative discretion rather than constitutionality, and thus it is reasonable to say that the effors of legislative branch to revise the 「the Road Traffic Act」at a desirable level is important. In particular, in this point we can refer to the California Vehicle Act(CVC) in that the Act is provided pursuing the establishment of multilateral policies and coping with changes in the road environment, and clear concepts for various means of transportation considering the road environment change in the 4th Industrial Revolution.
