흠흠신서에 나타난 살인죄에 대한 고찰

Jeong Yak-yong evaluates the Ming code in the Heum heum Sin seo. In other words, unlike the Dang Code, the Ming code consists of a provision for murder. In the Joseon Dynasty, the Ming code was used as a general criminal law. In the Ming code, various regulations on murder are collectively stipulated on one side to help judicial management or the general public know exactly. Unlike the current criminal law, there are several provisions depending on the type of behavior. Our criminal law also needs to be separately defined according to the degree of risk rather than defining the provisions of murder as a type. In the Heum heum Sin seo, it is said that a trial distorted by bribes should not be conducted to judge criminals who commit crimes equivalent to the death penalty. First, the crime to be applied through detailed and intensive investigation of evidence and witnesses is determined. In addition, intention and negligence must be judged, so if it cannot be proved intentional within the deadline, it should be judged as a negligence offender. In the case of negligence offenders, it is to find and apply a way to save lives through scriptures or laws. Jeong Yak-yong’s view of correcting the disorder of trial and punishment execution through fair and strict enforcement of the law against criminals and eventually creating an orderly society through trust in the ruler has great implications today.
