초록
학교 기능의 확대와 교원 업무 경감 등의 목적에 따라 행정업무와 교육활동을 지원하는 교육공무직원의 직종과 인력이 증대되고 각 시·도의 조례와 규칙을 통해 제도화되었지만, 교육공무직원의 신분, 처우 및 운영에 관한 논란과 이로 인한 갈등이 지속적으로 발생하여 교육서비스 제공에 혼란을 야기하고 있다. 본 연구에서는 교육공무직원 운용 관련 주요 쟁점과 이를 해결하기 위한 법령 및 제도 개선방안을 제안하고자 하였다. 특히 교육공무직의 주도적이고 책임감 있는 행위주체성 함양을 위해서는 신분, 처우, 임금 책정 방식, 직무체계 등의 다양한 영역에서 총체적인 변화가 필요하다. 이를 위하여 선행연구와 관련 법령에 기반하여, 교육공무직의 운용 현황과 주요 정책 동향을 분석하고, 현행 법제도에서의 교육공무직원의 구조적 한계와 운영의 문제점을 도출한 후, 법령 및 제도 개선 방안으로 교육공무직원의 법률적 근거 마련, 교육공무직원 전보 시행 의무화, 직종 통폐합 및 연수 등을 통한 교육공무직원 전문성 확보, 직무 분석 및 근무 평가 현실화 등을 제안하였다.
Abstract
According to the purpose of expanding school functions and reducing teacher duties, the non-regular non-teaching school staff who support administrative tasks and educational activities have been adopted. Since then, controversies over identity, treatment, and operation related to them have continued to arise. This study explored the main issues related to the management of the non-regular non-teaching school staff and the improvement measures of laws and regulations to solve them were proposed. In particular, in order to foster the initiative and responsible agency of the non-regular non-teaching school staff, it is necessary to make a total change in various areas such as status, treatment, wage setting method, and job system. To this end, the current status, the structural limitations and operational problems of the non-regular non- teaching school staff and major policy trends were analyzed based on prior research and related laws. As a way to improve laws and systems, the study proposed the legal basis for the non-regular non-teaching school staff, mandatory transfer, job consolidation and training, job analysis and job evaluation.
