리걸클리닉 교육 현황과 개선안으로서 공익법률사무소 운영

전국의 모든 법학전문대학원에 리걸클리닉센터가 설치되어 있고 대부분이 리걸클리닉 수업을 개설하고 있다. 그러나 그 중요성에 비하여 리걸클리닉 교육은 실질적으로 운영되지 못하고 정량적 평가기준을 형식적으로 맞추고 있는 것이 현실이며, 학교들 사이에 교육내용과 수업의 격차도 발생하고 있다. 리걸클리닉을 전담하는 인력이 부족하고 실제 사건을 수행할 수 있는 변호사가 없는 것이 근본적인 문제이므로 전담 변호사를 채용하고 실제 사건을 수행할 수 있는 시스템을 갖추는 것이 필수적이다. 또한 리걸클리닉 교육의 목적은 공적 마인드를 갖춘 법조인의 양성에도 있는 것이므로 공익사건의 수행과 프로보노 활동, 공익진로 개발도 간과해서는 안될 것이다. 리걸클리닉 교육 현황을 개선하기 위한 방안으로 법학전문대학원에 공익법률사무소를 설립하는 것을 제안하며 서울대학교 법학전문대학원 공익법률센터의 사업들을 중심으로 구체적인 운영방안을 제시하였다. 리걸클리닉 공익법률사무소는 지역의 법률구조 기관으로 법률서비스의 사각지대를 해소하는 사회적 기여를 할 수 있으며 법학전문대학원에서는 리걸클리닉 교육을 전담하는 조직이 될 것이다. 임상법학 교육에 대한 전문성을 가지고 지역사회 법률구조 클리닉을 통해 학생들과 실제 사건을 수행하고, 소속 변호사의 공익활동을 기반으로 다양한 공익인권 클리닉을 개설할 수도 있을 것이다. 수업 이외에 학생들의 공익활동을 지원하기 위하여 프로보노와 공익진로개발 프로그램을 운영하고, 공익법률사무소 자체가 재학생 실무수습과 변호사 실무연수 기관이자 지역의 공익변호사가 활동하는 기반이 될 수 있다. 리걸클리닉 교육이 실질적으로 운영된다면 법학전문대학원은 지역에서 사회적 역할을 다할 수 있고, 학생들에게는 사회적 약자를 위한 따뜻한 시선을 가진 법조인이 되기 위한 출발점이 될 수 있을 것이다.
Abstract
All law schools nationwide have legal clinic centers, and most of them offer legal clinic classes. Clinical legal education is important, but it is not well operated and only meets the evaluation standards. There is a gap in Clinical legal education among law schools. The problem is that there are no lawyers as clinical professor or instructor at legal clinic centers. It is necessary to hire lawyers and have a system that can carry out lawsuits. As a measure to improve Clinical legal education, it is proposed to establish a Public Interest Law Center at law schools, and specific operational plans are presented focusing on the projects being conducted at the Seoul National University School of law Public Interest & Legal Clinic Center. Public Interest Law Center at law schools can contribute to the community as a legal aid organization. and the center will be in charge of Clinical legal education at the law school. Public Interest Law Center can establish the Legal Aid Clinic and Public Interest and Human Rights Clinics based on the public interest activities of the clinical professors or instructors. In order to support students' public interest activities outside of class, pro bono and public interest career development programs can be operated, and community public interest lawyer can work at the Public Interest Law Center.
