균등침해의 제1,2 요건과 제4 요건의 연계에 관한 고찰

초록
균등침해의 제4 요건에서 다루었던 공지기술제외의 법리가 적극적 요건에서 판단될 경우, 발명의 과제해결원리와 작용효과의 판단에도 영향을 미치는 것으로 나타났다. 항변사항으로 주장하는 공지기술제외를 균등침해의제1 요건인 적극적 요건에서 판단할 경우, 특허발명 내 공지기술과 관련된구성의 상위 개념화 또는 추상화는 제한받게 된다. 그 결과 과제해결원리의동일성과 관련하여 구성요소 대 구성요소에 의한 판단도 함께 고려해야 할것이다. 또한 작용효과와 관련하여, 공지기술과 관련된 구성을 제외하고 균등침해의 제2 요건을 판단할 경우, 작은 차이도 설계 변경이 불가능하게 되므로, 공지기술이 포함된 구성을 제외하고 판단해서는 안 될 것이다. 한편, 공지기술제외에 관한 제4 요건을 제1, 제2 요건에서 함께 판단할 경우, 우회적인 특허발명의 진보성 평가가 되므로, 구성요소별 판단의 중요성이 커지게 된다. 그러므로 공지기술제외에 관한 제4 요건이 제1 요건 및 제2 요건과 연계함에 따라, 과제해결원리의 동일성과 작용 효과를 판단함에 있어 구성요소별 판단의 비중은 더욱 증가할 것으로 사료된다.
Abstract
When the principle of excluding publicly known art is judged in the positive requirements in the infringement by equivalents, it is found that the first and the second requirements will be affected. In the case of the first requirement, the generic conceptualization of the element will be limited. As a result, it is necessary to consider the judgment from comparison of each element regarding the identity of the principle underlying the solutions of the problems. If the second requirement is determined excluding publicly known art, even a small difference does not correspond to a design change. Thus, it should not be determined except for the publicly known art. On the other hand, when the fourth requirement is judged together in the first and the second requirements, the inventive step of the patent invention is evaluated substantially, so the judgement by each element will be more important. Therefore, as the fourth requirement is linked to the first and the second requirements, the proportion of judgment by each element in determining the identity of the principle underlying the solutions of the problems and the effect of the patent invention is expected to increase more and more.
