데이터 관련 법률 규정의 해석 및 입법론에 관한 고찰―저작권법과의 관계를 중심으로―

초록
최근 국가적인 전략과제의 일환인 ‘디지털 뉴딜’ 정책의 추진에 힘입어 그토대가 되는 자원으로서의 ‘데이터’에 대한 관심이 함께 증대되고 있으며, 민간에서도 인공지능 기술 및 유관 산업의 발전과 함께 그에 대한 논의가 지속되고 있다. 이러한 추세에 발맞추어 국회에서도 데이터의 보호 및 이용과 관련한 법률들이 발의되어 시행 중이거나 시행을 앞두고 있다. 그러나 제반 법령을 종합적으로 살펴보면 각 법률의 적용영역 및 규정 간 정합성의 측면에서 불명확한 부분들을 상당수 포함하고 있는바, 본 논문에서는 각 법률상의주요 개념들을 중심으로 규범조화적인 해석방안을 모색하고, 아울러 입법론적 차원에서 해당 규정의 타당성 여부를 검토해 보고자 하였다. 한편, 이같은 논의와는 별개로 현재 전면적·공세적으로 추진되고 있는데이터 보호에 관한 입법적 노력들이 관련 산업계의 수요를 충분히 반영한것인지, 그리고 기존 법률의 규정 취지와 관련 입법례에 대한 종합적인 검토가 이루어진 것인지에 관한 의문점은 여전히 남아 있다. 실제 현장에서의 법적용상의 혼란을 줄이고 데이터 산업의 유기적인 발전을 도모하기 위해서는, 향후 관련 법률의 제·개정 시 해당 법률의 입법 필요성 및 규율영역 등에 대한 명확한 제시가 필요하다고 할 것이다.
Abstract
Recently, the interest in ‘data’ as a base resource has been increased due to the promotion of ‘digital new deal’ policy, which is part of national strategic task, and discussions on it have been continuing with the development of artificial intelligence technology and related industries in the private sector. In line with this trend, laws related to data protection and use have been proposed in the National Assembly and are being implemented or are about to be implemented. However, comprehensively looking at all the laws and regulations, it contains many unclear parts in terms of the application area of each law and the consistency between regulations. In this paper, I tried to find a normative interpretation plan focusing on the main concepts of each law and to examine the validity of the relevant regulations in the legislative level.
