고려율령의 혼인무효규정에 보이는 고려의 결혼관 - 당·송과의 비교를 통하여 -

본 논문은 고려율령의 혼인무효조문을 당과 송의 비교에서 그 異同點을 찾아보았다. 첫째, 고려의 혼인무효조문은 당송의 것을 받아 정비되었다. 이는 다음의 금지조문에서확인이 된다. 즉 ① 근친혼, ② 중혼(여성), ③ 조부모와 부모가 감옥에 있을 때 혼인한경우, ④ 감림관과의 혼인, ⑤ 양천교혼 ⑥ 수절녀의 강제 재혼 ⑦ 창기를 처로 삼는 것등이다. 물론 이외에 율령에는 보이지 않지만, 실례에서 처벌조항을 볼 수 있는 것은 ⑧ 거짓으로 하는 혼인, ⑨ 부모 상 중의 혼인, ⑩ 중혼(남성) 등이다. 둘째, 이에 대한 형량은 당송과 일치하지 않는다. 다만 율령의 흐름을 보건대 고려후기로 갈수록 당의 질서보다는 송대의 질서가 반영되고 있다. 이는 혼인관념, 금혼범주, 주혼자의 조문 등에서확인이 된다. 셋째, 처벌 내용이 당·송과 상이한 것은 고려관습법의 영향으로 보인다. 고려는 불교 등의 다양한 사상체계로 국가질서를 유지하였으므로 유교적 질서가 정착되지 않은 사회였다. 따라서 유교적 예제에서 중요한 의식의 하나인 혼인관련 의례가 준수되기가 쉽지 않았다. 또한 서류부가혼과 이로 인한 양측적 친족질서, 동기의식 등이 율령에 그대로 반영되었다. 고려후기 성리학이 도입되면서 고려도 송대적 질서를 받아들이고, 이를 적극적으로 율령에 반영하여 정비되었다. 따라서 고려말기에 이르러서야 당송대적율령을 그대로 모방하는 조문이 완성되어 부계혈통 중심의 가족질서체제가 정비되었다.
Abstract
In this paper, we examine the differences between Tang and Song in the marriage invalidity regulation of Goryeo law. First, Goryeo's articles of invalidation of marriage were developed by Tang and Song's. This is confirmed in the following prohibited provisions :In other words, it can be confirmed that ① marriage with relatives, ② double marriage (female), ③ Marriage when grandparents and parents are in prison, ④ Marriage of a provincial officer, ⑤ Marriage of Yang-min and Slave, ⑥ Forced remarriage of a woman who keeps her fidelity ⑦ Marriage with a gisaeng. Of course, it is not found in Goryeo law, but the punishment provisions in the actual examples are ⑧ false marriage, ⑨ Marriage when parents died, ⑩ double marriage (male), etc. Second, the sentencing for this does not match that of Tang and Song. However, from the perspective of the law, the order of the Song Dynasty is reflected rather than the order of the Tang Dynasty as the latter part of the Goryeo period. This can be seen from the marriage notion, Regulations setting the categories for prohibiting marriage, and The role of a person in charge of marriage. Third, the difference in the content of punishment is thought to be due to the influence of the Koryo customary law. Goryeo was a society where Confucian order was not established. This reflects the fact that marriage-related rituals, one of the important ceremonies in Confucianism, were not observed very well. This atmosphere is due to the maintenance of national order in various ideological systems such as Buddhism. Law, also reflects marriage where the son-in-law lives in his wife's house and kinship based on this, and awareness of the kinship order. When sexual science was introduced in the latter half of Goryeo, Goryeo also accepted the order of the Song dynasty and actively reflected it in the decree. Therefore, at the end of Goryeo, a text that imitated the Tang-Song dynasty law was completed, and a family order system centered on patrilineal pedigree was established.
