사회보험 적용 범위 확대 방안- 전 국민 고용보험 로드맵 관련 쟁점을 중심으로 -
A Study on Policies to Expand Social Insurance Coverage: Focus on Issues Related to the National Employment Insurance Roadmap

코로나19 위기는 우리나라 고용보험의 한계를 뚜렷하게 드러냈다. 코로나19 위기가 임금근로자보다는 자영업자, 프리랜서들에게 더 큰 영향을 끼쳤음에도, 고용보험은 임금근로자를 더 보호했기 때문이다. 2020년 5월, 정부가 자영업자를 포함한 “전 국민 고용보험”을 도입하겠다고 밝힌 것은 이러한 비임금근로자가 겪는 고용상 어려움을 해결할 보편적 사회보험이 필요하다는 인식에 기반한 것이다. 2020년 12월 정부는 고용보험 적용 확대를 위한 구체적 계획인 “전 국민 고용보험 로드맵”을 발표했다. 그 로드맵에 따르면, 고용보험 적용 범위의 확대는 단계적으로 진행된다. 지금까지의 진행 과정은 다음과 같다. 먼저 예술인 고용보험은 2020년 12월부터 시행됐다. 특고 고용보험은 2021년 7월, 플랫폼 고용보험은 2022년 1월부터 시행됐다. 자영업자의 고용보험 적용과 관련해선 사회적 대화가 진행되고 있다. 그리고 고용보험의 관리체계와 관련해선 사업장 기반에서 소득 기반으로의 개편이 추진되고 있다. 이 글은 최근 추진된 사회보험 적용 범위 확대 정책인 “전 국민 고용보험 로드맵”의 추진 과정 및 그와 관련된 몇 가지 쟁점을 살펴본다. 관련 쟁점에 대해 이 글에서 검토한 내용은 다음과 같다. 첫째, 예술인 및 특고에 대한 소득 합산 신청 제도는 여전히 불완전하고 보조적 제도에 머물고 있다. 둘째, 고용보험법상 피보험자격의 이중취득 금지 조항를 재검토해야 한다. 셋째, 노무제공자의 적용 범위 확대는 보편성을 목표로 한다는 점을 항상 인식해야 한다. 마지막으로, 플랫폼 종사자의 고용보험 관리는 플랫폼 산업의 특성을 고려하여 거래 건별로 이뤄져야 한다.
Abstract
The COVID-19 crisis clearly revealed the limitations of Korea’s employment insurance. Although the COVID-19 crisis had a greater impact on the self-employed and freelancers than on wage-earners, the employment insurance provided more protection for wage-earners. In May 2020, the government announced that it would introduce “national employment insurance” including self-employed people, based on the recognition that universal social insurance is necessary to solve the employment difficulties faced by these non-wage workers. In December 2020, the government announced the “National Employment Insurance Roadmap”, a plan for expanding employment insurance coverage. According to the roadmap, the expansion of employment insurance coverage will be carried out in stages. The process is as follows. First, employment insurance was implemented for artists from December 2020. It was implemented from July 2021 for dependent self-employed and from 2022 for platform workers. Social dialogue is ongoing regarding the application of employment insurance for the self-employed. In addition, the reorganization of the employment insurance management system from workplace-based to income-based is being promoted. This article examines the recent implementation process of the “National Employment Insurance Roadmap,” the most important policy to expand the coverage of social insurance, and some issues related thereto. The contents reviewed in this article on related issues are as follows. First, the income addition application system for artists and the dependent self-employed remains still as an incomplete and auxiliary system. Second, the provisions prohibiting double acquisition of insured qualifications under the Employment Insurance Act should be reviewed. Third, it should always be recognized that expanding the scope of application of labor providers aims at universality. Lastly, management of employment insurance for platform workers should be done on a case-by-transaction basis, taking into account the characteristics of the platform industry.
