‘국토에 대한 권리’의 헌법적 정당화를 위하여

이 글은 비교적 최근 한국 사회에서 국토기본법을 비롯한 여러 실정법률의 기본적인 범주로서 논의되고 있는 ‘국토에 대한 권리’(the right to the National Territory)의 헌법적 정당화를 위하여 몇 가지 논점들을 미리 짚어 두려는 예비적 연구이다. 논의의 초점은 ‘국토에 대한 권리’가 문제로 등장하는 현재의 이론적 상황과 의미 맥락은 무엇이고, 나아가 이 새로운 권리의 헌법적 정당화를 위해서는 어떤 점들이 해명되어야 하는가 등이다. 저자는 오늘날의 법적 사유에서 공간이 언제나 시간의 뒷자리로 밀려나는 신세라는 점을 확인한 뒤, 이러한 일반적인 경향성과 관련하여 드라마틱한 이론적 변화를 보인 칼 슈미트의 사례를 살펴보면서 오늘날 헌법이론의 지배 패러다임과 대항 패러다임을 ‘액체 근대’ vs ‘대지의 노모스’로 정리한다. 이와 같은 맥락에서 대한민국의 헌법 문서가 말하는 ‘국토’의 의미는 소유권 지상주의의 공간 왜곡을 ‘깊은 거주’와 ‘비(非)부동산 땅’의 이념에 기초하여 교정하기 위한 출발점으로 해석해야 마땅하다. 마지막으로 저자는 ‘국토에 대한 권리’의 개념적 성숙을 위하여 ①환경 및 생태주의와 연계 ②풀뿌리 민주주의 및 자치분권과 연계를 제안하는 한편, ③사회적 공동자원(commons)의 차원에서 ‘~에 대한 권리’에 ‘~에 대한 의무’를 덧붙이는 것을 고려하면서 공공신탁 또는 총유의 법리를 재발견해야 한다고 제안한다.
Abstract
This article is a preliminary research for a constitutional justification of the right to the national territory. Following the example of Henry Lefebvre’s the right to the city, which was suggested 50 years ago, some theorists in Korean society recently proposed the right to the national territory as a constitutional or legal right of Korean citizens living within. In spite of quite hot discussion attracting the expert’s attention, the constitutional and legal nature and contents of the right has not been clarified yet. The author attempts to re-examine the basic tendency of Modern Jurisprudence, which is more inclined to the time-factor than the space-factor, and summarizes the fundamental framework of nowadays with ‘liquid modernity’ vs ‘the nomos of land’ by a review on the dramatic theoretical turn of Carl Schmitt. His next task is to find out the actual meaning of the national territory in the Korean Constitutional itself with two important concepts of ‘deep dwelling’ and ‘not-real estate land’. On top of these speculations, he suggests some fragments for the conceptual ripeness and constitutional justification of this new right.
