사회보장 분야 ILO 협약의 비준을 위한 한국사회보장법의 과제

국제노동기구(ILO)는 노동조건과 노동기본권 분야뿐만 아니라 사회보장 분야에서도 중요한 국제기준을 설정하고, 그 기준의 이행여부를 감독함으로써 각국의 사회보장 발전에 많은 기여를 해 왔다. 그러나 1991년 ILO에 가입한 우리나라는 사회보장 분야의 ILO 협약들을 한 개도 비준하지 않고 있다. 국제사회에서 대한민국의 위상을 생각할 때 조속히 사회보장분야 ILO 협약들을 비준하여야 한다. ILO 제102호 협약과 후속 협약들은 의료급여, 상병급여, 실업급여, 노령급여, 업무재해급여, 가족급여, 모성급여, 장애급여 및 유족급여 등 9개 급여에 대해서 급여사유, 인구적용범위, 급여수준, 수급자격, 급여기간 등에 대하여 최저기준과 상위기준을 제시하고 있다. ILO 제102호 협약과 그 후속협약들의 비준가능 여부를 판단하기 위해서는, 각 협약들의 내용을 정확히 파악하고, 한국사회보장법의 내용이 협약들이 제시하는 급여의 최저기준과 상위기준을 충족하는지 여부를 검토하여야 한다. 검토 결과, 우리나라의 사회보장제도 중, 의료급여, 실업급여, 노령급여, 업무재해급여, 모성급여는 후속협약들의 상위기준은 충족하지 못하지만 제102호 협약의 최저기준은 충족하고 있다. 따라서 제102호 협약의 9개 급여 중 5개 급여에 대해서는 현재 시점에서도 비준이 가능하다. 의료급여는 후속협약의 상위기준도 충족하므로 즉각적인 비준이 가능하고, 실업급여와 업무재해급여는 약간의 제도 개선을 하면 상위기준이 가능하다.
Abstract
The International Labour Organisation(ILO) has established the important international standards concerning the social security as well as the working conditions and fundamental labor rights since its foundation, has supervised the implementation of the international standards, and has contributed a lot to the development of social security in each country. But, Korea, which joined the ILO in 1991, has not ratified any ILO conventions concerning the social security. Considering the status of the Republic of Korea in the international community, the ILO Conventions concerning the social security should be ratified as soon as possible. ILO Convention No. 102 and the subsequent Conventions stipulate the minimum standards and the upper standards such as the contingencies covered, persons protected, benefit levels and payment period for the medical care, sickness benefit, unemployment benefit, old-age benefit, employment injury benefit, family benefit, maternity benefit, invalidity benefit, and survivors’ benefit. To ratify the ILO Convention No. 102 and its subsequent Conventions, it is necessary to review whether the contents of the Korean Social Security Act meet the minimum standards and the upper standards proposed by the Conventions. After reviewing the Korean social security systems, the medical care, unemployment benefit, old-age benefit, employment injury benefit, and maternity benefits meet the minimum standards of Convention No. 102, but fall short of the upper standards. Therefore, the immediate ratification of Convention No. 102 is possible. And the medical care can be ratified immediately by the upper standards.
