선박의 감항성 담보와 항해과실 면책

본 논문에서는 2021년 영국 대법원의 The CMA CGM Libra 판결을 소개하고, 선박의 감항성 확보와 운송인의 항해과실 면책의 구별기준을 중심으로 사안을 분석해 보았다. 본 판결의 몇 가지 해석론적 유의점들을 정리해 보면 다음과 같다. 첫째, 불감항 과실은 선박 및 그 설비의 물리적인 결함만을 의미하지 않으며, 최신 정보가 기재된 작업해도, 적절한 배관계획, 승조원의 정신적 능력, 엔진 기타 선박기관의 유지 보수와 관련된 선박 시스템의 적절성, 화물 선적의 적합성, 선박의 운항 이력 등 이러한 모든 사항들을 감항성 확보의 요소로 고려해야 한다. 둘째, 항행 안전에 있어 통항계획의 중요성을 고려할 때, 선박이 통항계획 없이 발항하거나 또는 안전운항을 위태롭게 하는 하자 있는 통항계획에 근거해 항해를 개시하는 경우, 해당 선박은 불감항 상태로 보아야 한다. 셋째, ‘항해’상의 과실은 불감항에 의해 발생한 손실 또는 손해의 배상청구에 대한 항변이 될 수 없다. 즉, 발항 당시 감항성 확보를 위해 상당한 주의를 다하여야 하는 헤이그 규칙 제3조의 감항능력 주의의무는 최우선적 의무이다. 따라서 운송인이 이러한 의무를 위반한 경우에는 항해과실 면책 항변이 배척되어야 한다.
Abstract
Purpose : The purpose of this paper is to introduce and analyze the duty of a carrier to provide a seaworthy vessel and to discuss the responsibility for errors in navigation or management of a ship based on The CMA CGM Libra [2021] UKSC 51. Research design, data and methodology : After analyzing articles on the Hague Rules and, in particular, The CMA CGM Libra case, this paper studies the scopes, application, and requirements of a carrier’s seaworthiness obligations and carrier’s exemptions from the liability caused by errors in navigation or management of a ship. Results : This paper confirms that the judgment of the U.K. Supreme Court clarifies the extent of a carrier’s obligation to render a vessel that is seaworthy, and at what point this applies–defining the concept of seaworthiness as illustrative, rather than prescriptive. Conclusions : This paper analyzes a 2021 U.K. Supreme Court decision, and studies the correlation of a carrier’s seaworthiness obligations and the carrier’s exoneration from errors in navigation. The obligation to render a vessel that is seaworthy extends to everything that a prudent owner would require to ensure safe passage prior to setting sail.
