국제법상 한반도 자결권에 관한 고찰 - 북한 급변사태를 중심으로 -

초록
최근 발발한 우크라이나 사태와 남북 관계 경색이라는 전기를 맞고 있는 현 시점에서 북한의 급변사태 및 이 사태에 따른 북한 주민의 자결권 행사 가능성, 그리고 현행 대한민국 헌법과의 충돌 가능성은 다시 되돌아봐야 할 중요한 주제이다. 이에 이 논문에서는 현 북한정권이 붕괴된 급변사태 시점에서 북한 주민이 대외적 자결권을 행사했을 때 발생할 수 있는 국제법적 문제를 검토하였다. 먼저, 대내적⋅대외적 자결권에 관한 국제사회의 논의를 분석하고, 자결권의 주체인 인민(peoples)의 요건이 무엇인지 살펴보았다. 이를 근거로 한반도 주민 전체 또는 북한 주민 단독으로 국제법상 자결권 주체인 인민의 요건을 충족하는지 분석하고, 급변사태 시 북한 주민의 대외적 자결권 문제를 제기하였다. 다음으로, 이 논문에서는 북한 주민이 급변사태 시점에서 대외적 자결권을 근거로 분리독립을 하거나, 주변국과 합병 또는 병합하고자 했을 때 발생할 수 있는 영토보전원칙, 국내문제 불간섭 원칙, 현상유지원칙의위반 가능성을 각각 검토하였다. 이를 통해 이 논문은 북한 급변사태 시 발생할 수 있는 다양한 시나리오를 설정하고, 이를 대비한 대한민국 정부의 정책적 사항과 전략을 제시하였다.
Abstract
This article examines the international legal issues that could arise if the current North Korean regime collapsed and North Koreans were able to exercise their right to external self-determination. First of all, it analyzes discussions in the international community regarding the right to internal and external self-determination and considers the requirements for the “peoples” — the subjects of the right to self-determination. Based on this, it examines the possibility of North Koreans raising the issue of exercising their right to self-determination in the event of a sudden change by analyzing whether the Korean people as a whole or North Koreans alone meet the requirements of self-determination under international law. Next, the study examines the possibility of North Koreans violating the principles of territorial integrity, non-intervention in domestic issues, and uti possidetis when they try to separate or annex or merge with neighboring countries. Based on this analysis, the paper contemplates various scenarios that could occur in the event of a sudden change in North Korea and suggests measures that the South Korean government can implement in preparation for such a situation.
