면책기간 경과 후의 자살에 관한 최근 판결의 검토와 자살사례 증가에 대한 보험자의 대응방안
A Study on the Recent Case of Suicide after Disclaimer Period and the Insurer’s Response to the Increase in Suicide Cases

최근 대법원 2022. 4. 28. 선고 2021다231406판결은 피보험자가 여러 건의 다액보험에 가입한 후 자살면책기간을 한달여 넘긴 시점에서 자살상태로 발견되자 피보험자의 유족이 보험금지급을 청구한 사건에서 면책기간 경과 후의 자살은 보험자 부책이라고 판단하였다. 이 판결은 보험자의 면책이 가능한지, 가능하다면 어떤 요건을 갖추어야 하는지에 대한 상세한 판단은 하지 아니한 채, 이 사건 여러 건의 보험계약에 대하여 부정목적계약이 아니라고 보았다. 보험자는 민법 제103조를 적용하여 이 사건 보험계약이 무효라고 주장하였으나 기각되었다. 만일 이 사건 보험계약이 부정목적계약으로 인정된다면 보험계약은 무효가 되고 보험자는 면책된다는 점에서 부정목적계약은 면책기간 경과 후의 부책조항을 적용할 필요도 없기 때문에 이 두가지는 표리의 관계에 있다. 법원은 이 사건의 두 가지 쟁점을 모두 다루었으나 부정목적계약으로 보험계약이 무효로 되는 경우에도 면책기간 경과후 자살조항에 따라 보험금을 주어야 하는지에 대하여는 적극적으로 밝히지 않았다. 그런데 일부 언론들이 이 사건 판결을 면책기간 경과 후의 자살에 대하여는 무조건 보험금을 주어야 한다는 판결이라고 보도하고 있어 일반인들이 오해를 할 가능성도 없지 않다. 우리나라에서는 2000년대 초에 면책기간 경과 후의 자살 문제가 조명된 바 있다. 당시 우리 사회는 자살자에 대한 재해보험금지급 여부가 크게 사회적 논란이 되던 때였다. 자살보험금 사태는 최근 소송이 진행 중인 즉시연금사태와 더불어 우리나라 보험역사상 가장 치열한 다툼이었다. 그러나 대법원 2016. 5. 12., 2015다243347 판결과 대법원 2016. 9. 30. 선고 2016다218713, 218720 판결을 계기로 논란은 소강상태에 접어들었다. 2021년 한편의 논문이 발표된 정도이다. 그러나 위 4. 28. 판결을 계기로 여러 가지 문제를 다시 논의할 필요가 커졌다. 본고는 위 판결을 소개하고, 면책기간 경과 후의 자살조항이 민법 제103조의 공서양속에 우선할 수 있는지를 검토한다. OECD 통계상 연간 자살률이 세계 최다인 우리나라에서 보험금을 노리고 자살을 꾀하는 사태가 조금이라도 증가한다면 불행한 일이다. 본고에서는 이를 미연에 방지할 수 있는 대책을 보험계약 관점에서 검토하고자 한다. 구체적으로는 표준약관과 개별 상품약관의 면책조항, 특히 면책기간 경과후 자살조항에 대한 해석을 유연하게 하는 방법, 면책기간을 연장하거나 보험자의 선택에 맡기도록 표준약관을 개정하는 방법, 고의사고면책을 규정한 상법 제659조와 제732조의2의 원칙으로 돌아가 모든 자살에 대하여 보험자면책으로 하는 방법, 부정목적계약 등에 대한 법리의 확장을 통하여 보험금을 노린 자살을 줄이는 방안 등이 그것이다. 이 문제를 살핌에 있어 필자는 특히 일본에서의 논의를 참고하였다. 일본은 한 때 세계 최고의 자살률을 나타낸 국가였던 까닭에 자살보험금에 대한 논의가 그 어떠한 나라보다 활발하였다. 우리나라에 아직 소개되지 않은 일본최고재판소 판결과 2010년 일본 보험법 개정과정에서의 논의 상황도 소개한다. 필자의 사견으로는, 상법의 고의사고 면책의 원칙으로 돌아가기는 쉽지 않아 보인다. 면책기간을 연장하는 방법은 채택에 무리가 없어 보이나, 자살방지 효과가 있을지 불확실해 보인다. 결국 부정목적 취득의 다수계약에 대한 요건을 보다 객관화하고, 보험자도 정보기술의 발달에 따라 다수계약을 걸러내는 노력이 필요해 보인다. 또한 피보험자의 자살에 대한 대응방법으로 그동안 민사계약관계에서 인정되던 신뢰관계파괴를 이유로 한 계약해지권을 보험계약에서도 인정하는 최근 대법원 판결도 주목할 필요가 있다. 일본 보험법 제30조의 해석상 과다계약이나 자살은 당사자 사이의 신뢰관계를 훼손해서 더 이상 계약을 유지할 수 없는 중대사유로 취급된다.
Abstract
In the recent Supreme Court decision, 2021da231406, delivered on April 28, 2022, it was found that the insured had died by suicide after purchasing multiple insurance policies. When the insured was found dead, it was more than a month after the period of the suicide exclusion specified in the insurance policy had passed. The bereaved family of the insured claimed the insurance payment against the insurer. In this case, the court held that the insurer should pay the insurance money for suicide if the insured committed suicide after the suicide exclusion period had passed. The court only held that the multiple insurance contracts, in this case, were not contracts for fraudulent purposes without making a detailed judgment on whether the insurer can be exempted from liability and, if possible, what requirements it must meet. In this case, the insurer claimed that the insurance contract would be invalidated by applying Article 103 of the Civil Act, but the court rejected this claim. If an insurance contract in this case is recognized as a contract for a fraudulent purpose, the insurance contract is void and the insurer is exempted from the liability. Thus, the suicide exclusion clause and the insurance contract for fraudulent purposes are deeply related. The court dealt with both issues in this case, but did not actively demonstrated whether insurance money should be paid according to the suicide clause after the indemnity period has elapsed, even if the insurance contract is invalidated due to a fraudulent contract. However, there is a possibility that the general public may be misunderstood the outcome of this case as some media argue that the judgment in this case is a decision that insurance money must be paid unconditionally for suicides after the expiration of the exemption period. However, there is a risk of seducing the insured to commit suicide. Some media argue that the court’s decision means that insurance money must be unconditionally paid if the insured committed suicide after the disclaimer period specified in the suicide exclusion clause has passed. In Korea, in the early 2000s, the issues of suicide exclusion in the insurance policy were highlighted. At that time, in our society, whether or not to pay disaster insurance for suicides was considerable social controversy. The claim related to the suicide exclusion was the most fiercely contested in the history of insurance in Korea, along with the immediate annuity case, which is currently being litigated. Nevertheless, the controversy regarding the suicide exclusion clause decreased with the decision of the Supreme Court 2015da243347 on May 12, 2016, and the 2016 Da218713 and 218720 on September 30, 2016. Only one paper regarding the issue was published in 2021. However, with the Supreme Court ruling on April 28, the need to discuss various related issues has been raised again. This paper introduces the judgment of the Supreme Court on April 28 and also reviews whether the suicide exclusion clause of the insurance policy can take precedence over the ‘juristic acts contrary to social order’ stated in Article 103 of the Civil Act. In Korea, where the suicide rate is the highest in the world according to OECD statistics, it would be unfortunate if the number of suicide attempts for insurance money increased even a little. In this paper, specific measures to prevent this in advance will be reviewed from the perspective of the insurance contract. The specific prevention methods include (1) flexible interpretation of the exclusion clause of standard terms and conditions and individual product terms, especially the suicide exclusion clause after the exemption period has elapsed; (2) amendment of the standard terms and conditions to extend the exclusion period or leaving discretion to change the exclusion period in the insurer’s hand; (3) exemption of the insurer from liability for all suicides of the policyholder under the principles of Articles 659 and 732-2 of the Commercial Act, which stipulate the immunity of the insurer for intentional accidents; and (4) prevention of suicide aimed at insurance money through the extension of legal principles on fraudulent contracts, etc. In examining this issue, the author expressly referred to the discussion in Japan. Since Japan once had the highest suicide rate in the world, the discussion of suicide exclusion in the insurance policy was more active than in any other country. The paper also introduced the Japanese Supreme Court ruling, which has not yet been introduced to Korea, and discussions during the revision of the Japanese insurance law in 2010. It does not seem easy to return to the principle of insurers’ immunity for intentional accidents under the Commercial Act. The method of extending the exclusion period seems acceptable to adopt, but it seems uncertain whether or not it has an effect on preventing suicide. Ultimately, it seems necessary to make the requirements for multiple contracts for fraudulent acquisition more objective. Insurers also need to make efforts to filter out multiple contracts for fraudulent purposes with the help of the development of information technology. In addition, as a countermeasure to the insured's suicide, it is worth paying attention to the recent Supreme Court decision regarding the insurance contract case which confirmed that ‘termination right of contract based on the material grounds’ which has been recognized in civil contract cases can also be recognized in the insurance contract cases. According to the interpretation of Article 30 of the Japanese Insurance Law, excessive contracting or suicide is treated as a material ground that harms the good relationship between the contractual parties and make it impossible to maintain the contract any longer.
