초록
이 글은 2009년 9월 27일 94세의 나이로 별세하신 독일 프라이부르크 <막스플랑크 외국 및 국제 형법연구소>의 창립자이자 전 소장인 한스 하인리히 예쇅(1915-2009)을 추모하는 저자의 추모사를 한국어로 옮긴 것이다. 예쇅은 한국의 형법 교과서와 문헌에서 지난 수십 년간 가장 많이 인용된 독일 형법학자 중의 한 사람이다. 1966년에 창립된 <막스플랑크 외국 및 국제 형법연구소>는 지난 반세기가 넘는 동안 여러 소장들을 거치면서 특히 비교형법과 국제형법의 영역에서 세계적으로 선도적인 역할을 하였다. 동 연구소는 2019년부터는 <막스플랑크 범죄와 안전 및 법 연구소>라는 새로운 이름과 함께 새로운 소장들과 새로운 연구체계로 새롭게 거듭나고 있다. 이런 의미에서 한국형법에도 큰 영향을 미친 이 연구소의 창립자인 한스 하인리히 예쇅의 생애와 형법사상을 되돌아보는 것도 의미 있는 일일 것이다. 한스 하인리히 예쇅의 학문적 활동은 비범한 폭과 깊이로 인해 두각을 드러낸다. 약 600여 편의 출판물이 있으며, 중점연구분야는 형법의 총론 전 분야, 무엇보다도 형사제재와 보안처분, 각론의 범죄들, 형사소송법, 사법공조, 국제형법 및 유럽형법이다. 그 중에서도 특히 탁월한 세 분야를 들면: 예쇅의 대작인 형법총론 교과서, 폭넓은 국제 중점분야 및 형법과 범죄학을 연결하는 것이다. 예쇅의 형법총론 교과서에서 중요한 토대가 되는 것은 특히 책임원칙과 인격적 불법론 및 인간적 제재체계이다. 또한 예쇅은 국제적 연구의 중점을 타당하게 비교형법에 두었으며, 비교형법은 그에게 중요한 연구대상인 동시에 핵심적인 연구방법이기도 했다. 1954년 교수취임강의 때‘비교형법의 발전과 과제 및 방법’을 분석하였는데, 이 작은 연구서는 지금도 비교형법의 훌륭한 입문서가 되고 있다. 나아가 한스 하인리히 예쇅의 국제적인 연구주제와 연구의 출발점은 종종 자신의 시대보다 훨씬 앞서가고 있었다. 이것은 특히 형법과 범죄학을 융합하는 그의 연구방법에서도 그렇다. 한스 하인리히 예쇅의 학제적인 연구에 대한 개방성과 미래의 발전에 대한 선견은 그가 사회적 변화의 배경 위에서 형법의 국제적인 근본 변화를 조기에 알아차리고 영향을 주었다는 것을 말해준다. 이런 의미에서 그는 연구주제와 연구방법의 선택에서 의심의 여지없이 선구자였다.
Abstract
This paper is a Korean translation of Hans Heinrich Jescheck's obituary, which was written by U.S. and published in ZStW in 2009. Prof. Dr. Dr. h.c. mult. Hans-Heinrich Jescheck was founder and former director of the Max Planck Institute for Foreign and International Criminal Law, professor emeritus at the Albert Ludwig University of Freiburg, former judge at the Karlsruhe Higher Regional Court, and for many years editor of the Zeitschrift für die gesamte Strafrechtswissenschaft. He was a doyen of German and foreign criminal jurisprudence, the recipient of numerous honorary doctorates and the holder of the highest national and international honors, who brought German criminal jurisprudence back into the international community after World War II. The academic work of Hans Heinrich Jescheck is characterized by an extraordinary breadth and depth. He has published around 600 articles, focusing on the entire general part of criminal law, and in particular on the law of sanctions and measures, the law of criminal procedure, mutual legal assistance, international criminal law, and European criminal law. Based on a selection, only three outstanding areas are mentioned here: his large textbook on the General Part of Criminal Law, his extensive international focus, and his combination of criminal law and criminology. In doing so, Hans-Heinrich Jescheck rightly placed comparative criminal law at the center of his international research focus, which was both an important research subject and a central research method for him. Hans Heinrich Jescheck can be sure that with his research, his teaching, his numerous lectures as well as especially with his textbook after World War II., he helped to shape a generation of lawyers in Germany and abroad. All this makes it clear how much Hans Heinrich Jescheck rendered outstanding services to people and the community as a researcher and teacher.
