일본의 최근 노동 및 사회보장정책 동향에 관한 고찰
A Study on the Recent Trends in Japan’s Labor and Social Security Policy

본 연구는 2021년 10월 4일부터 출범한 기시다 후미오 정권의 노동정책 및 사회보장정책의 동향을 고찰하여 시사점을 도출하는 것을 목적으로 한다. 일본은 아베 정권 시기에 일하는 방식 개혁의 일환으로 관련 노동관계 8개의 법령이 개정되어 노동법에서 큰 개정이 이루어졌다. 그 이후 새롭게 출범함 기시다 정권은 기본적으로는 아베 정권에서 실시되었던 정책의 기조를 유지하고 있는 것으로 보인다. 이러한 기존의 정책 및 제도와의 연장선상에서 “새로운 자본주의 실현 회의”와 “전세대 사회보장구축 회의”를 마련하여 노동과 사회보장과 관련된 논의를 시작하였다. 이에 본 논문은 먼저 노동정책과 관련된 것으로서, 지난 6월 7일에 각의결정된 “새로운 자본주의의 그랜드 디자인 및 실행계획”의 내용 중에서 임금인상의 추진, 기술향상을 통한 노동이동의 원활화, 다양성 존중과 선택의 유연성 등의 노동정책을 살펴보았다. 그리고 사회보장정책과 관련된 것으로서, 지난 5월 17일에 발표된 “전세대형 사회보장구축회의 논의 중간정리” 보고서의 내용 중에서 전세대형 사회보장 구축, 남녀가 활약할 수 있는 사회구축 및 자녀양육 지원, 근로자 개보험 실현 및 여성취업에 제약이 되는 제도 재검토 등 사회보장정책을 살펴보았다. 일본의 최근 노동 및 사회보장정책의 특징으로는 다양한 일하는 방식과 디지털 플랫폼 등의 기술혁신 바탕으로, 종래의 종신고용과 같은 정형화된 고용문화 등에서 다양성과 유연성을 존중하는 방향으로 노동정책이 마련되고 있다는 점이다. 또한 사회보장정책과 관련하여도, 그동안의 근로자 중심의 사회보장제도를 플랫폼노동종사자 등에게도 적용되는 방향으로 확대하고, 또한 여성들의 노동시장 진출에 제약이 되었던 사회보장 및 세재 등의 제도 개선을 제시하고 있다. 이러한 내용은 아직 법제도 구체화된 것은 아니지만, 그 방향성을 제시하고 있는 만큼 향후 법제도로의 실현에 귀추를 주목할 필요가 있다.
Abstract
This research aims to examine recent changes in Japanese labor and social security policies implemented by the Fumio Kishida administration, which was inaugurated on October 4th, 2021. In Japan, the eight labor-related acts of legislation were amended during the Abe regime as part of the country’s workstyle reform. The newly launched Kishida government appears to have maintained the basis of the policy implemented under the Abe administration. Alongside the existing policies and systems, the government established the “Council of New Form of Capitalism Realization” and “Council of Social Security Reform for All Generations” and began to discuss labor and social security issues. This paper will study labor policies, such as promoting wage increases, facilitating labor mobility through skill increase, and respecting the diversity and flexibility of selection among the contents of the “Grand Design and Action Plan for a New Form of Capitalism,” released on June 7th, 2022. Focusing on the contents of “Interim Report of Discussion in Council of Social Security Reform for All Generations,” published on May 17th, 2022, the present study aims to investigate Japan’s social security policy. The country made strides in establishing a social security system for all generations, supporting child-rearing, building society for supporting working men and women, realizing the worker’s universal insurance system, and reviewing systems that restrict women’s employment. Based on the country’s various work styles and technological innovations, such as digital platforms, Japan’s recent labor and social security policies, such as conventional lifetime employment, are prepared to respect diversity and flexibility in the standardized employment culture. In addition, Japan has expanded the social security system centered on workers to apply to platform/gig workers and the self-employed, and improvements in social security and taxation systems to facilitate women’s participation in the labor market. Although these advancements have not yet materialized into legislation, it is necessary to pay attention to the developments in the legal system as it suggests future policy and legal directions.
