문화정책의 관점에서 본 국내 지식재산정책 추진체계의 특징과 적절성 검토

본 연구는 지식재산 정책 추진체계 개편에 대한 기존 논의에서 문화 정책의 관점에서의 접근이 부족했다는 문제의식을 토대로, 한국의 지식재산 정책 추진체계의 특성을 검토하고, 문화 정책의 효과적 추진의 관점에서 지식재산정책 추진체계의 적절성을 논의한다. 특히 지식재산 정책추진체계에서 해결해야 할 문제는 단순한 관할 지식재산권의 단일화된, 혹은 분리된 관리의 방식이나 조정 기구의 유무가 아닌, 실질적으로 유기적인 ‘융합행정’을 위한 방향성을 모색하기 위한 노력이란 점에 주목한다. 저작권은 산업재산권과 달리 인격권과 결합되어 있다는 특수성을 가지며, 보호와 활용의 균형이 중요한 성격 때문에 민간과 국가정책의 조율 역시 산업재산권보다 훨씬 예민하고 섬세한 접근이 필요한 영역이란 점을 강조하고자 했다. 이를 통해 기존의 지식재산 정책 추진체계 논의가 기술 중심의 단선적 통합론으로 집중되어 있는 한계를 넘어서, 보다 근본적인 개별 지식재산 권리들의 발전 방향으로 문제의 프레임을 이동하기 위한 출발점을 마련하고자 했다.
Abstract
To establish the direction of an appropriate intellectual property policy system suitable for the Korean context amid changes in the environment surrounding intellectual property, this study examines issues and alternatives. The priority of the pending issues to be resolved in the intellectual property policy system is not the integration or separation of organizations, but the effectiveness of overall strategy establishment and adjustment and the securing of expertise in such policies for each field. We emphasize that, unlike industrial property rights, copyright is unique in that it is combined with personal rights, and that the balance between protection and utilization is important. Through this, this study established a starting point for moving the frame of the problem toward the more fundamental development of individual intellectual property rights, beyond the limits of the technology-centered unilinear integration theory in the discussion of the existing intellectual property policy system.
