미연방헌법상 조약권한과 주권의 균형적 조율방안에 관한 연구

초록
21세기 현재 국제사회는 과학과 기술의 발전과 상호의존적 국제경제통합 정책의 확산으로 더욱 더 연결되고 있다. 따라서 현재는 구시대적인 고립된 민족주의를 넘어 서서 인류전체의 복지와 평화를 수호하는 역할을 해낼 수 있는 국제기구 및 국가들의 대외정책들의 필요성이 필수불가결한 시점이라고 판단한다. 하지만 국제사회를 건설해 나가는 수단이 되는 법치주의 즉 국제법은 한 국가 주권과 한 시민의 자유권과의 관계에서 어느 정도 구속적이고 지켜져야 하는지는 끊임없이 논의가 필요한 어려운 문제이다. 본 논문에서는 첫째 미연방헌법상 조약의 권한이 헌법적으로 정립된 역사적 배경과 관련 주요한 조항들에 관한 분석을 한다. 둘째 미연방헌법상 조약권한과 주권의 균형적 조율과 관련된 전통적 판례들을 분석한다. 특별히 이러한 분석을 첫째 조약과 이와 한 입장으로의 미연방정부의 주권(Federal Sovereignty), 둘째 미연방정부의 주권과 대립하는 50개 주정부의 주권(State Sovereignty), 셋째 주 안에서 거주하는 한 개인의 자유권(Civil Liberty)과의 관계를 중심으로 진행한다. 마지막으로 이러한 삼각형적인 관계를 중심으로 미연방헌법상 조약권한과 주권의 균형적 조율방안을 모색하기 위한 최신 판례분석 후, 관련 이론을 통해서 검토한 후 개선방안을 도출해 보고자 한다.
Abstract
This era is the very time that all the nations need to cooperate through the international rule of law since scientific technology and the system of international economic integration policy have made all the nations as very close neighbors to one another. Therefore, all the nations and international organizations need to take a step further to carry out their foreign policies and instruments in order to establish peace and to improve the welfare of entire human race with overcoming the old-fashioned way of thinking, ‘Isolated Nationalism’. However, it is still very difficult legal problem to decide how much power the national sovereignty needs to confer her powers to treaty powers specially in relation with civil liberty with a view to establish the international rule of law. Thus, this study first of all researches on the provisions and historical backgrounds of treaty powers specified on American Constitutions, and then studies on the relate important cases. Lastly, this study brings on much debate and philosophical discussions on finding out the right position of check and balance among the tree factors of ‘Treaty Power as the same position with ‘Federal Sovereignty’, ‘State Sovereignty’ and ‘Civil liberty’ in order to contribute to building a trustworthy international society rooted on international rule of law.
