한국 이민정책 결정과정에서의 조직간 협력 분석-관련 법제도 규정을 중심으로

초록
현재 한국에서 추진하고 있는 주요 이민정책분야는 법무부가 총괄하는 외국인정책과 여성가족부가 총괄하는 다문화가족정책 등이다. 이 들 정책이 갖는 특징 중의 하나는 관여하는 조직이 많고 다양하다는 것이다. 이렇게 많은 조직이 관여하는 정책이 성공적으로 기획, 집행되기 위해서는 조직간 협력이 필수적이다. 이에, 본 연구에서는 이들 두 개 정책분야를 대상으로 기본계획, 시행계획수립 등 정책이 결정되는 시점에서 위원회, 중앙행정기관, 지방자치단체, 공공기관, 민간단체 등 다양한 조직간 협력이 자료협조, 정책내용협의, 정책조정 등의 차원에서 어떻게 이루어지고 있는가를, 해당 정책이 근거하는 재한외국인처우기본법과 다문화가족지원법을 대상으로 법·규정을 분석하였다. 분석결과, 두 개 정책분야 공히 협력의 유형중 가장 소극적인 자료협조에 대해서는 일방향적이긴 하나 공통적으로 규정이 존재하고 있고, 적극적인 내용협의나 위원회조직을 통한 조정으로서의 조직간 협력 규정은 미흡한 것으로 나타났다. 협력을 하는 데 있어서의 조직간 관계에 있어서는 총괄기관과 중앙행정기관간, 혹은 중앙행정기관과 지방자치단체간의 관계에서 상호협력적인 것보다는 일방적 관계로 규정되어 있었다. 또한 두 개 정책분야를 비교해볼 때 다문화가족정책이 좀 더 소극적으로 규정이 운영되고 있는 것으로 나타났다. 향후 이러한 제반 문제점에 대한 제도 개선 노력이 요구된다고 하겠다.
Abstract
The main areas of immigration policy currently being promoted in Korea are foreign policy by the Ministry of Justice(FP), and multicultural family policy by the Ministry of Gender Equality and Family(MFP). One of the characteristics of these policies is that the organizations involved are numerous and diverse. Cooperation between organizations is essential for successful planning and implementation of policies involving so many organizations. Therefore, in this study, how cooperation between various organizations involved in these two policy areas is being conducted was analyzed targeting the Framework Act on the Treatment of Foreigners Residing in the Republic of Korea and the Multicultural Families Support Act on which the policies are based. As a result, data cooperation, which is the most passive among the types of cooperation in both policy fields, is one-way but universal. Cooperation as an active content discussion or coordination through committee organization was found to be insufficient. The pattern of relationship was defined as a unilateral relationship rather than a mutual cooperation in the relationship between the general agency and the central administrative agency, or between the central administrative agency and the local government. Comparing the two policy fields, the MFP is being operated more passively than FP.
