사생활 언론보도에 의한 인권침해의 사법적 판단기준: 유럽인권재판소의 ‘카롤린 공녀’ 관련 판결례를 중심으로

유럽인권재판소는 청구인인 모나코 공국의 공녀 카롤린(Caroline, Princess of Hanover)이 크게 세 차례에 걸쳐 제소한 사건에서, 잡지사가 청구인의 사생활을 담은 사진을 보도한 것이 청구인의 유럽인권협약상 사생활의 자유를 침해하였는지 여부를 판단하였다. 이 글에서는 위 사건에 관한 유럽인권재판소의 대상판결을 통해, 사생활의 언론보도에 따른 사생활의 자유 침해 주장과 언론 표현의 자유가 충돌하는 사안에 있어 양자 사이의 형량을 위하여 유럽인권재판소가 어떠한 판단기준을 제시하고 있는지를 살펴보았다. 유럽인권재판소는 크게 두 측면의 공사분리에 입각하여 상이한 판단을 내렸는데, 첫째로 이른바 인적 공사분리와 관련하여 유럽인권재판소는 공무수행 여부를 들어 보도의 대상이 된 당사자가 국가의 공식적 기능을 수행하는 자가 아니라면 그는 공적 인물이 아닌 사적 인물이기 때문에 보다 사생활에 대한 존중이 강하게 요구된다고 보았다. 둘째로 물적 공사분리와 관련하여 유럽인권재판소는 문제된 언론 보도가 공공의 토론에 기여할 수 있는지 여부를 평가함으로써, 단순히 대중의 오락적 흥미를 충족하기 위한 목적으로 작성된 사생활에 관한 기사의 경우 언론의 자유를 통해 두텁게 보호될 수 없다고 보았다. 이러한 유럽인권재판소의 판단기준은 나름의 의의와 한계를 가지는바, 이는 충돌하는 두 권리 사이에서의 적절한 형량을 위한 고려요소로 평가되어야 할 것이다. 우리 법원 역시 유사한 견지에서 특정인의 사생활에 대한 언론 보도가 문제된 사건들에서 여러 판단기준을 제시해왔으므로, 대상판결과 같은 유럽인권재판소의 판결례를 비판적으로 검토, 참조하여 그 판단기준의 일관성과 명확성을 제고할 수 있을 것이다.
Abstract
The European Court of Human Rights (“the Court”) decided whether the tabloid coverage of the private life of the applicant, Princess Caroline of Monaco, violated her right to privacy enshrined in the European Convention on Human Rights(“the Convention”), in its three consecutive rulings. This article aims to examine what legal criteria the Court has adopted in order to balance two conflicting rights of the Convention in cases where a media coverage of one’s private life is disputed; the right to privacy and the freedom of press (or the right to expression). The Court introduces two strands of private-public divide as its major criteria; firstly, regarding the ‘subjective’ private-public divide, the Court points that if the person whose private life has been covered by media does not hold an official title or position in a state, that person is not a public but private figure, thus requiring a stronger protection for one’s right to privacy. Secondly, regarding the ‘objective’ private-public divide, the Court asks whether that media coverage can contribute to a debate of public interests; if the article was written solely for the sake of the public’s entertainment, the Court can rule that it is not entitled to a higher level of protection of the freedom of press. Such legal criteria suggested by the Court have their own pros and cons, and they constitute a factor that should be considered while seeking the proper balance between two conflicting rights. Likewise, the South Korean courts have offered various yet similar criteria in cases where a media coverage of certain person’s private life is at issue; therefore, the critical analysis and reference of the Court’s jurisprudence including the Caroline cases are recommended to improve the coherence and clarity of such criteria adopted by the Korean courts as well.
