[번역문] “세상이 멸망할지라도 정의를 행하라” ―격언에 대한 칸트의 번역에 관하여―

이 글은 페터 크라우제 고희기념논문집에 수록된 라이너 차칙의 논문을 한국어로 번역한 것이다. 기념논문집의 주인공과 저자의 학문상 공통점은 칸트 법철학에 대한 관심이다. 이런 이유로 이 글에서는 이 위대한 인물의 저작에서 발췌한 한 주제를 다루고 있다. 또한 이 글의 제목에서 인용한 ‘세상이 멸망할지라도 정의를 행하라’는 격언은 한국인에게도 너무나 익숙한 표현이다. 그러나 이 격언에 대한 칸트의 번역은 내용적으로나 해석학적으로도 잘 다루어지지 않은 것이며, 저자는 이 격언에 대한 칸트의 번역을 칸트 (법)철학의 전체 맥락에서 매우 인상적인 방식으로 분석하고 있다. 정의의 실현은 모두의 자유적인 삶을위해 꼭 필요한 것이다. 정의의 위기라고도 할 수 있는 현 상황에서—법의 근본의미와 방향을 제시해 주는 칸트의 법철학적 사유를 성찰하는—저자의 숙고는 우리에게 많은 것을 시사해 준다. 왜냐하면 정의의 집은 바로 법이기 때문이다. <도덕형이상학>의 법론보다 이년 앞선 1795년에 발간된 칸트의 저서 <영구평화론>에는 ‘부록’이라는 표제가 붙은 부분에 ‘영구평화의 견지에서 본 도덕과 정치 간의 불일치에 관하여’라는 장이 나온다. 이 장에서 칸트는 이 글의 제목으로 인용한 격언을 다음과 같은 방식으로 소개하고 있다: “호언장담 같이 들리고 격언처럼 회자되지만, 참된 명제인 fiat iustitia, pereat mundus, 독일어로는 ‘세상의 악한들이 모두 몰락하더라도 정의가 지배하도록 하라’는 간계 혹은 폭력에 의해 도모된 모든 사악한 길들을 가로막는 옹골찬 법원칙이다 (…)”. 칸트는 무엇 때문에 격언에 대해 이렇게 자유로운 번역을 하며, 무엇 때문에 격언을 참되다고 하고, 그의 법철학의 맥락에서 보면 격언은 무엇을 의미하는가? 이 글에서는 바로 이것을 해명하고 있는데, 칸트의 번역은 좀 더 자세히 살펴보면 그 속에 그의 법철학과 일반적으로 실천철학의 요소들이 어떤 방식으로 들어 있는지 혹은 번역의 정신에서 암시되고 있는지를 보여 준다.
Abstract
This paper is the Korean translation of a contribution by Rainer Zaczyk, which was published in 2006 in the Festschrift for Peter Krause. The author and the jubilarian have in common their affection for Kant’s philosophy. Therefore, the present text also deals with a topic from the work of this great man―albeit in a not quite ordinary way. In Kant’s writing “On Perpetual Peace”, published in 1795 and thus two years before his doctrine of law in the “Metaphysics of Morals”, the section “On the discord between morality and politics, with a view to perpetual peace” is found in a part of the text entitled “Appendix”. In this section Kant introduces the aphorism quoted in the title of the essay in the following way: “The somewhat prestigious-sounding phrase, which has come into circulation as a figure of speech, but which is true: fiat iustitia, pereat mundus, which means in German: ‘let justice prevail, let the rogues in the world also perish altogether over it’, is a valiant principle of law, cutting off all crooked paths marked out by guile or force (…)”. How does Kant arrive at this seemingly very free translation of the sentence, why does he declare it to be true, and what does it then mean in the context of his philosophy of law? This paper explains this. Kant’s translation shows on closer examination how the elements of his philosophy of law and―in general―of his practical philosophy are contained in it, or at least echo in the spirit of the translation.
