디자인 도면형식요건에서의 실무적 쟁점에 관한 연구

In this study, the domestic and foreign practice trends of formal requirements for views of design drawing was examined. The following practical issues arise during the application of formal requirements for views. Firstly, as the reference views are separated from the aspect views, confusion occurs during filing and formality examination, the consistency of drawings is damaged by submitting reference views irrelevant to the design features and different viewpoints arise in the interpretation of reference views in examination and trial practice. Secondly, due to the independent view identification item applied to a particular protection of design, incongruity with overseas practice may occur. And depending on mixed submission, a double application and confusion may occur during substantive examination. In addition, the design of complex products and set products using the same view identification item may cause confusion about design protective nature. As an alternative to the above problems, an idea to abolish reference views and simplify them into a single view identification item and to abolish view identification item of the particular protection of design was proposed. Complementarily, it is necessary to study the non-formal view submission system considering of the applicant's emotional needs in the domestic situation.
