가상경제시대에서 메타버스 플랫폼의 역할과 법적 책임에 관한 소고

4차 산업혁명 시대가 도래하면서 IT 기술의 발전 속도가 급진전됨에 따라 메타버스의 개념이 부상하고 있다. 디지털 전환의 급진전 속에서 메타버스를 실제로 구현할 수 있게 됨에 따라, 메타버스의 산업적ㆍ경제적 가치가 현실화되고 있다. 메타버스 시대는 현재의 인터넷을 기반으로는 하는 경제와 다른 모습의 디지털 경험을 제공하는 경제 시스템을 구축할 것으로 전망되고 있다. 메타버스로 인하여 다양한 사회경제적 문제가 발생할 것으로 예측되고 있으며, 이러한 문제에 대해 법제도적인 변화가 요구될 것으로 보인다. 이에 본고에서는 가상경제 시대의 주요한 플랫폼으로 등장하고 있는 메타버스의 다양한 지식재산 관련 쟁점 중에서 플랫폼 사업자로서의 메타버스가 가지는 법적 책임에 대해 검토하였다. 그 결과, 메타버스 플랫폼 사업자의 법적 지위가 명확하지 않은 상황에서 특정 법률에 따라 법적 지위를 결정하는 것은 한계가 있어 보였다. 따라서, 메타버스 플랫폼에 대한 특별법을 입법할 필요성은 있다. 그러나, 메타버스가 할 수 있는 비즈니스 유형이 명확하게 정리되지 않은 상황과 초국경적인 서비스가 이루어지는 메타버스의 특징을 고려할 때, 충분한 사전적 검토를 실시할 필요가 있다. 이에 앞서 현재 발생하고 있는 메타버스에서의 지식재산 침해행위에 대해서는 기존의 법리를 통해 해결이 가능할 것으로 보인다.
Abstract
With the advent of the 4th industrial revolution, the concept of Metaverse is emerging as the speed of IT technology development accelerates. As the Metaverse can be actually implemented amid the rapid pace of digital transformation, the industrial and economic value of the Metaverse is becoming a reality. The age of Metaverse is expected to establish an economic system that provides a digital experience that is different from the current internet-based economy. It is predicted that various social and economic problems will arise due to the Metaverse, and legal and institutional changes are likely to be required for these problems. Therefore, in this study, the legal responsibility of Metaverse as a platform operator among various intellectual property related issues of Metaverse, which is emerging as a major platform in the age of virtual economy, is reviewed. As a result, in a situation where the legal status of the Metaverse platform operator was not clear, there seemed to be a limit to determining the legal status according to a specific law. Therefore, there is a need to legislate a special law for the Metaverse platform. However, it is necessary to conduct a sufficient preliminary review considering the situation in which the types of business that the Metaverse can do are not clearly arranged and the characteristics of Metaverse that provides transboundary services. Prior to this, it seems that the intellectual property infringements currently occurring in the Metaverse can be resolved through the existing legal principles.
