로블록스의 케이팝 지식재산권 침해 현황과 구제방안

초록
메타버스가 IT 기술 환경에서 크게 부각되면서, 메타버스를 대중화한 대표적 서비스 중 하나인 로블록스의 지식재산권 침해 문제가 지적되고 있다. 로블록스는 게임적 요소를 가진 일종의 커뮤니티 공간으로, 이용자는 아바타가 되어 다른 사람이 만든 공간에 참여하여 서로 소통할 수 있고, 자신이 직접 게임을 만들어 플랫폼에 올려서 다른 사용자가 즐기도록 할 수도 있다. 로블록스에서는 케이팝과 연결된 다양한 지식재산권 침해가 발생하고 있다. 케이팝 음악과 안무가 서비스되고 있어 이용자가 자유롭게 선택할 수 있고, 각 게임 배경으로 케이팝 가수 사진과 앨범 재킷 이미지가 제공되고 있다. 케이팝 가수의 로고 등 상표가 적용된 응원봉과 디지털 굿즈을 구입하여 내 아바타에 장착하기도 한다. 문제는 이 모든 것이 권리자의 허락없이 제공되고 있다는 것이다. 본 논문에서는 로블록스를 중심으로 케이팝 산업과 연관되는 지식재산권 침해 사례를 구체화하여 살펴본다. 로블록스 플랫폼과 그 안에서 제공되는 서비스의 법적 성격을 살펴보고, 어떤 형태의 침해 이슈가 발생하는지를 저작권, 상표권, 디자인권 등 지식재산권 유형에서 분석한다. 저작권 측면에서 음악, 안무, 사진, 미술의 침해 문제를 다루며, 산업재산권 측면에서는 케이팝 가수의 이름과 로고 등 상표권과 디지털 상품의 디자인권을, 퍼블리시티권 측면에서 부정경쟁방지법 적용 여부도 확인할 것이다. 그리고 플랫폼 사업자로서 로블록스의 책임 범위와 함께 케이팝 산업 보호를 위한 합리적인 지식재산권 보호 방안을 제안하고자 한다.
Abstract
As the metaverse has come to the fore in the IT technology environment, the problem of intellectual property rights infringement of Roblox is being pointed out. Roblox is a community space with game elements, where users can become avatars and participate in spaces created by others, or create their own games for other users to enjoy. In this paper, we examine cases of intellectual property infringement related to the K-pop industry with a focus on Roblox. It examines the legal nature of Roblox services and analyzes what kind of infringement issues accur in intellectual property rights such as copyrights, trademarks, and design rights. In terms of copyright, it deals with infringement of music, choreography, photography, and art, In terms of industrial property rights, it will check whether trademarks and digital products such as K-pop singers' names and logos are applied and the Unfair Competition Prevention Act in terms of publicity rights. In addition, I would like to propose a reasonable intellectual property protection plan to protect the K-pop industry along with the scope of Roblox's responsibility as a platform operator.
