초록
아파트형태의 집합건물은 1970년대 이후 급증하였으며, 오늘날 일반화되기에 이르렀다. 이러한 수도권을 중심으로 하는 주택부족현상을 양적공급의 확대를 통해 해결하기 위해 ‘분양제도’와 ‘청약제도’라고 하는 2가지 공급/수요시스템을 통해 공급자와 수요자간에 있어 규범화된 제도를 통해 주택시장을 통제하고자 하였다. 특히, 선분양제도는 주택 관련 재원을 소비자에게 전가하는 방식으로 주택공급을 확대하고자 하였던 건설사와 정부의 이해관계를 대변하는 적극적인 정책수단의 역할을 하였다. 그러나 대금을 선지급하고 목적물을 사후에 인도받은 형식의 ‘분양’은 구조적으로 불안정적이며 매수인에 해당되는 수분양자의 지위를 열악하게 한다. 또한 분양이라고 하는 방식으로 거래된 아파트에서 발생하는 물건의 하자로 인한 분쟁은 거의 모든 아파트에 발생하고 있다. 이처럼 발생하는 신축아파트의 하자와 관련된 끈이지 않는 분쟁, 심지어 건설 중인 아파트가 붕괴하는 참사에 이르기 까지 선분양 아파트와 관련된 문제는 일로 증가하고 있다. 나아가 이러한 분쟁에서 소비자는 자신들의 권리를 충분히 보장받고 있다고 말할 수 없는 구조적위치에 놓여 있다. 이러한 문제점들로 인해 신축집합건물의 거래방식에 대한 법리적 재정립과 구조적 변화의 필요성이 있다. 미완성 신축집합건물에 대한 매매계약의 법제도를 균형적으로 정비할 필요가 있다. 이러한 정비의 필요성과 법리적 근거를 뒷받침하기 위해 집합건물의 분양이라고 하는 제도의 개념과 법적 성격을 분석함으로써 본 제도의 실체를 파악 한다.
Abstract
Condominium housing is a very common type of housing nowadays. Condominium type of housing started to increase suddenly after the 1970s in KOREA. The government wanted to control the 'pre-subscription', 'pre-sale' and real estate shortage system in order to solve the housing shortage centered in the metropolitan area through quantitative supply expansion. Recently, disputes related to newly built condos are frequently occurring. In such disputes, the pre-sale system of condos puts consumers at a structural disadvantage. Because of these problems, there is a need for re-establishment and structural change in the legal theory of the transaction method of new condominiums. In particular, it is necessary to balance the legal system of sales contracts for unfinished condominiums. Therefore, by analyzing the concept and legal characteristics of the system of condominium sales, the reality of this system is understood.
