자율운항선박촉진법의 제정 필요성 및 제정 방향

자율운항선박은 제4차 산업혁명의 대표적인 기술 중 하나로 최소인원의 선원이 승선하거나 선원의 개입 없이 항해할 수 있는 선박으로서, 해운물류분야 전반에 패러다임의 전환과 막대한 사회적·경제적 파급효과를 가져올 미래 유망 신산업분야이다. 2020년부터 2025년까지 해양수산부와 산업자원통상부 주도로 기술개발을 추진하는 등 기술개발 사업은 매우 활발하게 이뤄지고 있지만, 이에 반해 자율운항선박 도입을 위한 법적 지원체계가 전무하다. 물론 자율운항선박 규제혁신로드맵과 경남 무인선박 규제자유특구가 있지만, 여기에는 여러 가지 한계가 존재하기 때문에 별도의 자율운항선박촉진법이 제정되어야 할 것이다. 이에 일본, 중국, 노르웨이의 법제에 대한 비교법적 고찰을 통해 제5장에 걸쳐 제30개 조문으로 구성된 자율운항선박촉진법을 제안하였다. 물론 이 논문에서 논의된 내용 외에도 책임 및 보험제도 등 상용화 이전에 정비가 필요한 법률문제들이 상당히 많이 남아있다. 그럼에도 불구하고 자율운항선박촉진법 제정은 자율운항선박 관련 법제도가 전무한 현재 상황에서 자율운항선박을 법적 규율로 포섭하여 기술개발 및 상용화를 촉진하기 위해 시작점이 될 것이다.
Abstract
MASS(Maritime Autonomous Surface Ships) are a promising new industry that will bring paradigm shifts and enormous social and economic ripple effects throughout the shipping and logistics sector. Technology development projects are being carried out very actively from 2020 to 2025, led by the Ministry of Maritime Affairs and Fisheries and the Ministry of Commerce, Industry and Energy, but there is no legal support system for MASS. Despite there is a road map for regulatory innovation of MASS and a special zone for regulatory freedom of unmanned ships in Gyeongnam, but since there are various limitations, a special MASS Promotion Act should be enacted. Accordingly, After Comparative Study of Japan, China, and Norway, The writer suggest specific MASS Promotion Act which consists of 30 provisions throughout Chapter 5. The enactment of the MASS Promotion Act is expected to be a starting point to promote technology development and commercialization, including legal improvements.
