日本行政手続法規定の意見公募手続に関する探索的研究

초록
本稿は義務の意見公募手続と任意の意見募集手続の制度概要と、 制度制定の経緯、 理論的背景を整理 した。 制度概要と実施状況から義務の意見公募手続と任意の意見募集手続を区別して検討する意義があ ることを示した。 また行政責任⋅統制論のうち、 行政機関の視点から「アカウンタビリティ⋅レスポン シビリティ」概念と、 「義務の意見公募手続⋅任意の意見募集手続」の対応関係を提示した。 国民の視点 から行政統制の時期を「事前コントロール⋅事後コントロール」に分け、 同様に「義務の意見公募手続⋅ 任意の意見募集手続」の対応関係を提示した。 本人―代理人理論における国民と行政機関それぞれの視 点から責任概念と統制概念を整理することで、 行政責任⋅統制論と意見公募手続制度の結節点を明確に している。 行政法学および行政学領域における意見公募手続制度に対する消極的な評価を導出した。 そ のうえで、 意見公募手続に関する研究を概観し行政機関によって事前調整が行われていることや制度 運用の瑕疵に対する措置が存在しないこと、 行政機関に硬直化の作用がみられることを課題として整理 した。 今後、 国におけるパブリック⋅コメント制度は、 説明責任を中心とする義務の意見公募手続と任 務的⋅応答的責任を中心とする任意の意見募集手続の相互補完的な運用が望まれる。 そのために、 意見 公募手続によくいわれるところの国民への制度の周知という課題よりも優先して、 行政機関による手 続の運用方法と制度的課題の早急な見直しが求められる。
Abstract
This paper summarizes the system overview of the compulsory public opinion process and the voluntary public opinion process, the history of the establishment of the system, and the theoretical background. From the outline of the system and the implementation status, it was shown that it is meaningful to distinguish between the compulsory public opinion collection procedure and the voluntary opinion collection procedure. In addition, in the theory of administrative responsibility and control, I presented the correspondence between the concept of “accountability/responsibility” from the viewpoint of administrative agencies and the “procedures for soliciting public opinions on obligations and procedures for soliciting voluntary opinions”. From the public's point of view, the period of administrative control is divided into “pre-control and ex-post control”, and similarly, the corresponding relationship between “compulsory public opinion collection procedure and voluntary opinion collection procedure” is presented. By organizing the concept of responsibility and the concept of control from the perspectives of the people and administrative organs in the principal-agent theory, I clarified the connection point between the theory of administrative responsibility and control and the public comment solicitation procedure system.
