법학교육 환경으로서의 메타버스와 그 법적 문제의 시론적 논의

COVID-19가 팬데믹(pandemic)이라는 용어를 전세계 인류에게 체감하게 하면서, 인류는 준비되지 않은 채 변화에 급박하게 적응해야만 했다. 대학 교육도 예외는 아니었다. 불가피하게 전체적으로 시행된 ‘원격수업’(distance learning) 전환이라는 환경의 변화에 다양한 모습으로 대처했다. 그렇게 2년 6개월이 지났으나, 아직 COVID-19가 종식되지 않고 있고, 이제는 이렇게 형성된 교육환경을 우리는 또 다른 정상(new normal)으로 받아들이고 있다. 이러한 흐름을 반영하듯 교수와 학생은 처음과는 달리 원격수업에 적응하였고, 오히려 효과적인 원격수업에 대하여 생각하게 되었다. 대학은 새로운 사회인을 배출하는 장으로서 가장 먼저 사회의 변화에 호응하여 학생들을 교육하여야 한다. 그러한 책임은 법학교육에도 부과된다. 그동안 법학의 특성상 법학교육은 기술환경 적응에 더딘 행보를 보여 왔다. 그러나 지금의 법학 교육을 받는 학생들도 다른 학문 영역의 학생들과 마찬가지로 ICT 활용과 소비력이 높은 디지털 네이티브들로서 어려서부터 인터넷 공간을 경험했기에 그들에게 디지털 세상은 비현실이 아니라, 현실의 일부이다. 이들에게 메타버스는 ‘소통 부족’이라는 한계를 직면하고 있는 현재의 법학 원격 교육에 새로운 교육 방법론을 제시하고 있다. 이제 법학교육에서도 ‘무엇을 배우느냐’, ‘왜 배우느냐’와 더불어 ‘어떻게 배우느냐’를 고민해야 할 시대가 된 것이다. 이러한 인식에서 이하에서는 법학교육에서의 메타버스 활용 필요성을 살펴보기 위하여 플랫폼 선정단계부터 과목 선정, 교수자의 콘텐츠 제작 및 학생의 참여 등에 대한 논의를 교육학적인 측면도 고려하여 학제적으로 융합하여 살펴본다. 이 과정에서 교육의 공간으로서 메타버스는 학습자 중심의 교육에 효과적이라는 것을 정리해 본다. 법학교육에 있어서 학습자 중심의 수업은 PBL(Problem Based Learning)에 적합한 모의재판 수업이나 사례 연습을 위주로 한 과목이라는 의견을 제시한다. 마지막으로 법학교육의 장으로서의 메타버스를 활용하는 경우에 발생할 수 있는 법적인 문제와 준비 사항, 강좌 진행시 발생할 수 있는 문제들과 그 대비책, 메타버스 플랫폼 사업자의 책임에 대하여 살펴본다. 특히 메타버스 수업 구축단계에서의 저작권 침해 등의 문제와 강좌 진행 중 발생할 수 있는 수업 구성원 간의 성범죄 등 최근 언론에서 제기된 형사적인 문제까지 살피고 이를 위한 메타버스 플랫폼에서의 조치는 무엇이 있는지를 함께 살펴본다.
Abstract
COVID-19 made the word ‘pandemic’ popular and forced us to adjust ourselves to rapid changes including education in universities. We had to cope with distance learning which was inevitably introduced and after two and a half years, it still persists and we have to accept this educational environment as a new normal. Not only adapting ourselves to this form of education, we began to endeavor to make an effective form. As a training facility and providing place of new social elements, we have to adapt to new environment first to educate them well. This applies to law education as well, though there has been little progress in new technology in this area so far. The students majoring law also had a lot of experiences in ICT, so digital environment is already a part of their lives. So comes Metaverse as a new method in law education which is now suffering from less communication. Now at this point, ‘learning how’ became a major subject along with ‘leaning what’ and ‘why’. With these acknowledgements, this study contemplates on platform selection, choosing subjects, making contents by teacher and students’ parcipitation in accordance with education system. This study could suggest Metaverse could be effective in learner-centered education, especially it fits for PBL(Problem Based Learning) subjects like mock trial or case study. Lastly, legal issues, preparation and problems during lecture associated with Metaverse as a law educational method are looked upon. The legal issues raised recently like copyright infringement and sex offense in metaverse will be reviewed and the solutions as well.
