보험소비자 보호를 위한 노폴트 자동차보험제도에 관한 연구: 뉴질랜드의 사고보상제도를 중심으로

[Purpose]By considering and evaluating the New Zealand’s no－fault insurance system, we tried to present a plan to introduce the no－fault automobile insurance system for solving the problems of the compensation system for personal injuries of Korean automobile insurance, which is being implemented to relieve victims of automobile accidents. [Methodology]For this purpose, a literature study was conducted to improve the problem of compensation for personal injuries in the Korean automobile insurance system, focusing on domestic and foreign studies published on the accident compensation system in New Zealand, that is, the no－fault insurance system. [Findings]This study found that the introduction of the no－fault automobile insurance system will increase fairness and speed in compensation for personal injuries caused by automobile accidents, reduce the overall social costs arising from delay in compensation due to claims and waste of litigation costs, and provide an appropriate response to accidents of autonomous vehicles. [Implications]Since Korea adopts the tort system, the automobile insurance system has limitations. So a more effective compensation system to protect victims should be considered. The New Zealand’s compensation system, which has been successfully implemented for more than 50 years, provides various implications.
